Blainey v. The Ontario Hockey Association and the Ontario Human Rights Commission (1986)

Download appellant's factum - Ontario Court of Appeal:

Download factum of the Canadian Association for the Advancement of Women :

A 12-year-old girl was prevented from playing on a boy's hockey team based on regulations from the Ontario Hockey Association and the Canadian Amateur Hockey Association. The Ontario Human Rights Code prohibited sex discrimination complaints to be filed against sports organizations. LEAF sponsored the intervention by the Canadian Association for the Advancement of Women and Sport to present arguments to the court regarding the best means of advancing women in sports and the application of the Charter to sports governing bodies. The Ontario Court of Appeal determined that the Ontario Human Rights Code was in violation of the Charter in its refusal to consider sex discrimination complaints. This ruling was significant in applying the Charter to provincial human rights legislation.
