The Queen v. O'Connor (1995)

Download factum:

LEAF and a coalition of women's organizations intervened before the B.C Court of Appeal in the case of Bishop O'Connor who was charged with the rape and indecent assault of four Aboriginal women. At O'Connor's pre-trial, the complainants were ordered to disclose all records kept by counselors, therapists, psychologists and psychiatrists related to allegations of sexual assault or sexual abuse.
In a unanimous decision, the Court ruled that the evidence sought by Bishop O'Connor was not relevant either to an issue in the proceeding or the competency of the complainants to give evidence.
