R. v. Mills (1999)

In this case, the court upheld an important law that limits an accused person's access to personal records in sexual offense proceedings. Given that the Court had set out a different test just four years earlier in the O'Connor case, the judicial endorsement of the legislation was a vindication.

It validated the decade -long struggle by LEAF and other organizations to ensure that the issue's equality dimension was accorded the same consideration as the rights of the accused.
