Irshad v. Ontario (Ministry of Health) (2001)

The panel of three judges of the Ontario Court of Appeal ruled that there was no violation of rights under Section 15 of the Charter. This case was a constitutional challenge to Ontario legislation, which excludes most new immigrants from OHIP coverage for a period of three months or longer. If the new immigrants have disabilities, the lack of coverage may be for an indefinite period because, on the basis of their disabilities, they are not recognized as "permanent residents" of Ontario.
