Broomer v. Ontario (2003)

Download factum:

This case concerned the constitutionality of the Ontario government's lifetime ban on welfare for those convicted of welfare fraud, under sections 7, 12 and 15 of the Charter. LEAF obtained intervener status in Broomer along with the Canadian Association of Elizabeth Fry Societies (CAEFS), the Charter Committee on Poverty Issues (CCPI), the DisAbled Women's Network (DAWN) Canada, the National Association of Women and the Law (NAWL), and the Income Security Advisory Clinic (ISAC). The case follows up on LEAF's intervention in the Kimberly Rogers inquest in 2002 in coalition with a number of the same groups.
The hearing was originally set for October 2003 in the Ontario Divisional Court; however, a newly elected provincial government decided to repeal the lifetime ban and the action was withdrawn.
