R. v. Mills

In this case, the SCC upheld an important law that limits an accused person’s access to personal records in sexual offense proceedings. Given that the Court had set out a different test just four years earlier in the O’Connor case, the judicial endorsement of the legislation was a vindication.

It validated the decade -long struggle by LEAF and other organizations to ensure that the issue’s equality dimension was accorded the same consideration as the rights of the accused.
