Alliance du Personnel\u202fProfessionnel\u202fet Technique de la Sant\u00e9 et des Services\u202fSociaux (2018)"},"content":{"rendered":"\n<p>Cette affaire concernait l\u2019acc\u00e8s des femmes \u00e0 l\u2019\u00e9quit\u00e9 salariale.<\/p>\n\n\n\n<p>Le FAEJ est intervenue devant la Cour supr\u00eame du Canada, en coalition avec:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The Equal Pay Coalition<\/li><li>The New Brunswick Coalition for Pay Equity<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>En 1996, le Qu\u00e9bec a adopt\u00e9 une loi obligeant les employeurs de 10 employ\u00e9s ou plus \u00e0 verser un salaire \u00e9gal pour un travail de valeur \u00e9gale. Dix ans plus tard, moins de la moiti\u00e9 des employeurs s&rsquo;\u00e9taient conform\u00e9s et moins de deux tiers avaient m\u00eame commenc\u00e9 \u00e0 cr\u00e9er un plan. En 2009, le Qu\u00e9bec a modifi\u00e9 la loi pour obliger les employeurs \u00e0 revoir leurs progr\u00e8s en mati\u00e8re d&rsquo;\u00e9quit\u00e9 salariale tous les cinq ans au moyen de v\u00e9rifications. Si les v\u00e9rifications montraient que les femmes n&rsquo;\u00e9taient pas r\u00e9mun\u00e9r\u00e9es \u00e9quitablement, les employeurs \u00e9taient tenus d&rsquo;apporter des changements \u00e0 l&rsquo;avenir. Les femmes ne recevraient pas d&rsquo;arri\u00e9r\u00e9s de salaire pour des salaires injustes.<\/p>\n\n\n\n<p>Plusieurs syndicats ont contest\u00e9 un certain nombre de dispositions de la loi, arguant qu\u2019elles violaient&nbsp; les droits en vertu de l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\">15<\/a> de la<em> Chartre. <\/em>Le juge du proc\u00e8s a conclu que les dispositions \u00e9taient inconstitutionnelles. La Cour d&rsquo;appel du Qu\u00e9bec a confirm\u00e9 la conclusion. Le Qu\u00e9bec a interjet\u00e9 appel devant la Cour supr\u00eame du Canada.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ, l\u2019Equal Pay Coalition, et la Coalition pour l\u2019\u00e9quit\u00e9 salariale du Nouveau-Brunswick (la Coalition pour l\u2019\u00e9galit\u00e9) a exhort\u00e9 la Cour supr\u00eame \u00e0 appliquer une analyse robuste de l\u2019\u00e9galit\u00e9 qui reconna\u00eet la mani\u00e8re dont la discrimination syst\u00e9mique structure le travail des femmes.<\/p>\n\n\n\n<p>La Equality Coalition a fait valoir que, \u00e9tant donn\u00e9 que la discrimination sexuelle syst\u00e9mique est si profond\u00e9ment enracin\u00e9e, il est n\u00e9cessaire de proc\u00e9der \u00e0 un examen continu et actif des pratiques au lieux de travail. Sans ces examens, des \u00e9carts salariaux discriminatoires r\u00e9appara\u00eetraient avec le temps. En exigeant des v\u00e9rifications de l&rsquo;\u00e9quit\u00e9 salariale seulement \u00e0 tous les 5 ans et en refusant aux femmes un recours pour la discrimination salariale r\u00e9elle subie pendant cette p\u00e9riode, les dispositions ne pr\u00e9voyaient qu&rsquo;une protection \u00e9pisodique, intermittente et incompl\u00e8te des droits \u00e0 l&rsquo;\u00e9galit\u00e9. Cette approche n\u2019a pas permis de traiter l\u2019\u00e9quit\u00e9 salariale comme un \u00e9l\u00e9ment normal et l\u00e9gitime des droits en milieu de travail et n\u2019a pas r\u00e9ussi \u00e0 int\u00e9grer l\u2019\u00e9galit\u00e9 des femmes dans les normes fondamentales du milieu de travail.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultats<\/h2>\n\n\n\n<p>Une majorit\u00e9 de la Cour supr\u00eame a estim\u00e9 que les dispositions discriminatoires fond\u00e9es sur le sexe, violaient l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\">15<\/a> &nbsp;de la <em>Chartre et ne pouvaient pas \u00eatre sauv\u00e9 par l\u2019art.<\/em> <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2a\">1<\/a>.
