Johnstone (2014)"},"content":{"rendered":"\n<p>Cette affaire concernait la signification de la discrimination fond\u00e9e sur la situation familiale.<\/p>\n\n\n\n<p>Le FAEJ est intervenue devant la Cour d&rsquo;appel f\u00e9d\u00e9rale.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>Fiona Johnstone et son mari travaillaient pour l&rsquo;Agence des services frontaliers du Canada (ASFC). Aucun des deux n&rsquo;avait des horaires de travail pr\u00e9visibles, et Mme Johnstone a donc demand\u00e9 \u00e0 l&rsquo;ASFC de lui permettre d&rsquo;avoir un quart de travail r\u00e9gulier afin de pouvoir prendre des dispositions pour la garde d&rsquo;enfants. L&rsquo;ASFC a accueilli la demande d&rsquo;un quart de travail fixe pour d&rsquo;autres travailleurs, qui ont fait la demande pour des motifs religieux ou m\u00e9dicaux, mais a refus\u00e9 de le faire pour Mme Johnstone. L&rsquo;ASFC a d\u00e9clar\u00e9 que ses d\u00e9cisions en mati\u00e8re de garde d&rsquo;enfants relevaient du domaine du choix personnel. Mme Johnstone a ensuite r\u00e9duit son poste \u00e0 temps plein \u00e0 un poste \u00e0 temps partiel pour assurer la garde des enfants.<\/p>\n\n\n\n<p>Mme Johnstone a d\u00e9pos\u00e9 une plainte relative aux droits de la personne. Le Tribunal canadien des droits de la personne a conclu que l&rsquo;ASFC avait fait preuve de discrimination \u00e0 son \u00e9gard en raison de sa situation familiale et lui avait accord\u00e9 des dommages-int\u00e9r\u00eats pour la perte de salaire et d&rsquo;avantages sociaux, ainsi que pour la douleur et la souffrance. La Cour f\u00e9d\u00e9rale a confirm\u00e9 une grande partie de la d\u00e9cision du Tribunal. L&rsquo;ASFC a interjet\u00e9 appel de la d\u00e9cision devant la Cour d&rsquo;appel f\u00e9d\u00e9rale.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ a soutenu que le motif de \u00ab l\u2019\u00e9tat de famille \u00bb incluait les responsabilit\u00e9s de soignante d\u00e9coulant des relations familiales. La r\u00e9alit\u00e9 sexosp\u00e9cifique des responsabilit\u00e9s en mati\u00e8re de prestation de soins signifiait que l&rsquo;exclusion de ces obligations de la d\u00e9finition de la situation familiale aurait un impact n\u00e9gatif sur les travailleuses, minerait l&rsquo;\u00e9galit\u00e9 r\u00e9elle et contredirait la l\u00e9gislation de longue date sur les droits de la personne. Les all\u00e9gations de discrimination fond\u00e9e sur l&rsquo;\u00e9tat de famille ne n\u00e9cessitaient pas de test nouveau ou diff\u00e9rent de celui des autres all\u00e9gations de discrimination.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultats<\/h2>\n\n\n\n<p>La Cour d\u2019appel f\u00e9d\u00e9rale a rejet\u00e9 l\u2019appel de l\u2019ASFC, mis \u00e0 part certaines variantes du recours accord\u00e9 \u00e0 Mme Johnstone. La Cour a fermement rejet\u00e9 une d\u00e9finition restrictive du \u00ab statut familial \u00bb qui n&rsquo;incluait pas les obligations parentales telles que la garde des enfants.
