Keays (2008)"},"content":{"rendered":"\n<p>Cette affaire concernait le r\u00f4le des droits de la personne et de la non-discrimination dans les contrats de travail.<\/p>\n\n\n\n<p>Le FAEJ est intervenu devant la Cour supr\u00eame du Canada.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>Kevin Keays a travaill\u00e9 pour Honda Canada pendant 11 ans avant de recevoir un diagnostic de syndrome de fatigue chronique. Il a cess\u00e9 de travailler pendant un certain temps, mais est revenu et a travaill\u00e9 dans un programme d\u2019invalidit\u00e9 apr\u00e8s que l\u2019assureur de Honda a mis fin \u00e0 ses prestations. Honda a par la suite mis fin \u00e0 l&#8217;emploi de M. Keays apr\u00e8s qu&rsquo;il ne voulait pas rencontrer un m\u00e9decin comme Honda l&rsquo;avait demand\u00e9.<\/p>\n\n\n\n<p>M. Keays a poursuivi pour cong\u00e9diement injustifi\u00e9. Le juge du proc\u00e8s a conclu que M. Keays avait \u00e9t\u00e9 cong\u00e9di\u00e9 \u00e0 tort. Il a accord\u00e9 \u00e0 M. Keays une r\u00e9mun\u00e9ration de 15 mois tenant lieu de pr\u00e9avis, qu\u2019il a port\u00e9 \u00e0 24 mois en raison de la discrimination, du harc\u00e8lement et de l\u2019inconduite de Honda \u00e0 l\u2019encontre de M. Keays. Il a \u00e9galement accord\u00e9 \u00e0 M. Keays 500 000 $ en dommages-int\u00e9r\u00eats punitifs. Une majorit\u00e9 de la Cour d&rsquo;appel a r\u00e9duit les dommages punitifs \u00e0 100 000 $. Les deux parties ont interjet\u00e9 des appels devant la Cour supr\u00eame du Canada.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ a fait valoir que les contrats de travail devraient avoir un terme implicite reconnaissant les obligations en mati\u00e8re de droits de la personne, y compris l&rsquo;obligation de ne pas discriminer. Cela signifierait que, lorsque les employeurs enfreignent les droits de la personne de leurs employ\u00e9s (par exemple par une discrimination telle que le harc\u00e8lement sexuel), les employ\u00e9s pourraient recevoir des dommages-int\u00e9r\u00eats civils pour les pr\u00e9judices subis. Ils ne seraient plus limit\u00e9s au d\u00e9p\u00f4t de plaintes en mati\u00e8re de droits de la personne &#8211; au lieu de cela, ils pourraient \u00e9galement intenter des poursuites civiles pour discrimination par les employeurs. Cela am\u00e9liorerait l&rsquo;acc\u00e8s \u00e0 la justice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultat<\/h2>\n\n\n\n<p>La Cour supr\u00eame a convenu que M. Keays avait \u00e9t\u00e9 cong\u00e9di\u00e9 \u00e0 tort. Cependant, la Cour a conclu que M. Keays n&rsquo;aurait pas d\u00fb recevoir de dommages-int\u00e9r\u00eats punitifs. Une majorit\u00e9 de la Cour a \u00e9galement conclu que Honda n\u2019avait pas agi de mauvaise foi ou n\u2019avait pas fait preuve de discrimination en mettant fin \u00e0 l\u2019emploi de M. Keays, et que M.
