Terre-Neuve (2004)"},"content":{"rendered":"\n<p>Cette affaire concernait le droit \u00e0 l&rsquo;\u00e9quit\u00e9 salariale pour les femmes de Terre-Neuve.<\/p>\n\n\n\n<p>Le FAEJ, avec le soutien de West Coast FAEJ, est intervenu devant la Cour supr\u00eame du Canada.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>En 1988, le gouvernement de Terre-Neuve-et-Labrador a sign\u00e9 un accord sur l&rsquo;\u00e9quit\u00e9 salariale pour les femmes dans le secteur de la sant\u00e9, y compris celles repr\u00e9sent\u00e9es par la Newfoundland Association of Public Employees (NAPE) dans les n\u00e9gociations collectives. En 1991, ce m\u00eame gouvernement a introduit la Public Sector Restraint Act, qui a report\u00e9 l&rsquo;augmentation salariale promise de 1988 \u00e0 1991. Cela signifiait que les travailleurs n&rsquo;avaient plus droit aux 24 millions de dollars pour les diff\u00e9rences salariales entre 1988 et 1991. Le gouvernement a justifi\u00e9 ce changement en se fondant sur la crise financi\u00e8re \u00e0 laquelle la province \u00e9tait confront\u00e9e.<\/p>\n\n\n\n<p>Un certain nombre de femmes touch\u00e9es par les r\u00e9ductions de salaire ont d\u00e9pos\u00e9 des plaintes. Le conseil d&rsquo;arbitrage (le conseil) a conclu que le changement violait l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\"><em>15 de la Chartre<\/em><\/a><em> <\/em>et ne pouvait pas \u00eatre sauv\u00e9&nbsp; sous l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2a\">1<\/a>. Lors du contr\u00f4le judiciaire, le juge des requ\u00eates a infirm\u00e9 la d\u00e9cision de la Commission, concluant que la violation \u00e9tait justifi\u00e9e en vertu de l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2a\">1<\/a>. La Cour d&rsquo;appel de Terre-Neuve-et-Labrador a donn\u00e9 raison au juge des requ\u00eates.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ a fait valoir que le gouvernement avait l&rsquo;obligation l\u00e9gale de rem\u00e9dier \u00e0 sa propre discrimination salariale fond\u00e9e sur le sexe. Il a soulign\u00e9 que, lorsque le gouvernement commettait des in\u00e9galit\u00e9s de r\u00e9mun\u00e9ration, il d\u00e9valorisait les contributions des femmes \u00e0 la soci\u00e9t\u00e9 et envoyait le message que l\u2019in\u00e9galit\u00e9 des femmes n\u2019\u00e9tait pas une responsabilit\u00e9 publique. En revenant sur sa promesse d&rsquo;\u00e9quit\u00e9 salariale, le gouvernement a continu\u00e9, tol\u00e9r\u00e9 et aggrav\u00e9 la discrimination \u00e0 l&rsquo;\u00e9gard des femmes, que la violation sous l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\">15<\/a> ne peux pas justifi\u00e9e sous l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2a\">1<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultat<\/h2>\n\n\n\n<p>La Cour supr\u00eame du Canada a conclu que la modification du r\u00e9gime d&rsquo;\u00e9quit\u00e9 salariale violait l\u2019art.<a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\"><em>15 de la Chartre<\/em><\/a>. Cela renfor\u00e7ait l&rsquo;id\u00e9e que les femmes pouvaient \u00eatre moins bien pay\u00e9es simplement parce qu&rsquo;elles \u00e9taient des femmes, affirmant essentiellement une politique de discrimination fond\u00e9e sur le sexe que le gouvernement venait tout juste de condamner. Cependant, la Cour a estim\u00e9 que le changement \u00e9tait justifi\u00e9 en vertu de l\u2019art <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2a\"><em>1 de la Chartre<\/em><\/a>.
