Canada (2003)"},"content":{"rendered":"\n<p>Cette affaire concernait la constitutionnalit\u00e9 des crit\u00e8res d&rsquo;admissibilit\u00e9 aux prestations d&#8217;emploi, qui emp\u00eachaient effectivement les travailleurs \u00e0 temps partiel de b\u00e9n\u00e9ficier de l&rsquo;assurance-emploi.<\/p>\n\n\n\n<p>Le FAEJ est intervenu devant la Cour d&rsquo;appel f\u00e9d\u00e9rale.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>Kelly Lesiuk a travaill\u00e9 \u00e0 temps partiel comme infirmi\u00e8re \u00e0 Brandon, au Manitoba. Apr\u00e8s que son mari a eu trouv\u00e9 un emploi \u00e0 Winnipeg, elle a d\u00e9m\u00e9nag\u00e9 l\u00e0-bas et a demand\u00e9 d&rsquo;abord l&rsquo;assurance-emploi (AE), puis des prestations de maternit\u00e9. Elle a \u00e9t\u00e9 refus\u00e9e car elle n&rsquo;avait travaill\u00e9 que 667 heures au cours de la p\u00e9riode de r\u00e9f\u00e9rence et la Loi sur l&rsquo;assurance-emploi exigeait qu&rsquo;elle ait travaill\u00e9 700 heures pour avoir droit aux prestations. Elle a interjet\u00e9 appel devant le conseil arbitral, mais l&rsquo;appel a \u00e9t\u00e9 rejet\u00e9. Elle a ensuite fait appel au juge-arbitre, qui a jug\u00e9 que les crit\u00e8res d&rsquo;admissibilit\u00e9 violaient l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\"><em>15 de la Chartre<\/em><\/a> car ils discriminaient en fonction du sexe. Le gouvernement a demand\u00e9 \u00e0 la Cour d&rsquo;appel f\u00e9d\u00e9rale une r\u00e9vision judiciaire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ a fait valoir que les conditions d&rsquo;\u00e9ligibilit\u00e9 \u00e9taient discriminatoires \u00e0 l&rsquo;\u00e9gard des femmes et violaient l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\">15<\/a>. L&rsquo;exigence d&rsquo;admissibilit\u00e9 bas\u00e9e sur les heures excluait de mani\u00e8re disproportionn\u00e9e les femmes des prestations. Il pr\u00e9f\u00e9rait le travail r\u00e9mun\u00e9r\u00e9 \u00e0 temps plein et pour toute une ann\u00e9e selon le mod\u00e8le \u00ab masculin \u00bb compar\u00e9 au travail r\u00e9mun\u00e9r\u00e9 et non r\u00e9mun\u00e9r\u00e9 des femmes. Les exigences ne tenaient pas compte des facteurs li\u00e9s au sexe qui distinguent les mod\u00e8les d&#8217;emploi des hommes et des femmes.<\/p>\n\n\n\n<p>Le fait de refuser de mani\u00e8re disproportionn\u00e9e des avantages aux femmes a eu un impact n\u00e9gatif sur le bien-\u00eatre \u00e9conomique des femmes. Elle a \u00e9t\u00e9 particuli\u00e8rement d\u00e9vastatrice pour les parents seuls, les immigrants r\u00e9cents, les femmes autochtones, les femmes racialis\u00e9es et les femmes handicap\u00e9es.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultat<\/h2>\n\n\n\n<p>La Cour d&rsquo;appel f\u00e9d\u00e9rale a admis que Mme Lesiuk avait subi une diff\u00e9rence de traitement en raison de son sexe et de son statut parental. Cependant, la Cour a estim\u00e9 que les exigences n\u2019avaient pas cr\u00e9\u00e9 ni renforc\u00e9 de st\u00e9r\u00e9otypes ou de pr\u00e9jug\u00e9s et qu\u2019elles n\u2019avaient donc pas port\u00e9 atteinte \u00e0 la dignit\u00e9 humaine de Mme Lesiuk.
