Minto Management (2002)"},"content":{"rendered":"\n<p>Cette affaire concernait le droit au logement des \u00e9poux apr\u00e8s la s\u00e9paration.<\/p>\n\n\n\n<p>Le FAEJ, en partenariat avec le Centre pour les droits \u00e0 l\u2019\u00e9galit\u00e9 au logement (CERA) est intervenu devant la Cour sup\u00e9rieure de justice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>Alba Torres vivait avec son mari et ses enfants dans un appartement lou\u00e9 de Minto Management. Mme Torres et son mari se sont s\u00e9par\u00e9s plus tard. Son mari a quitt\u00e9 l&rsquo;unit\u00e9, mais a inform\u00e9 Minto que Mme Torres et leurs enfants continueraient \u00e0 y vivre. Minto a d\u00e9clar\u00e9 \u00e0 Mme Torres que, pour continuer \u00e0 y vivre, elle devrait signer un nouveau bail avec une augmentation de loyer de 41%. Mme Torres a saisi le Tribunal du logement locatif, qui a jug\u00e9 qu&rsquo;elle n&rsquo;\u00e9tait pas locataire. Mme Torres a interjet\u00e9 appel devant la Cour sup\u00e9rieure de justice de l&rsquo;Ontario.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ et le CERA ont soutenu que la d\u00e9finition de \u00ab locataire \u00bb devait inclure le conjoint de la personne qui a pay\u00e9 le loyer. Sinon, la d\u00e9finition viole l\u2019art. <a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\"><em>15 de la Chartre<\/em><\/a> en raison de son impact disproportionn\u00e9 sur les femmes, qui:<\/p>\n\n\n\n<p>\u2022 \u00c9taient plus vuln\u00e9rables que les hommes aux crises du logement<\/p>\n\n\n\n<p>\u2022 \u00c9taient moins susceptibles d&rsquo;avoir un revenu et donc moins susceptibles de payer un loyer directement au propri\u00e9taire<\/p>\n\n\n\n<p>\u2022 Ont \u00e9t\u00e9 plus susceptibles de contribuer au m\u00e9nage sous forme de travail non r\u00e9mun\u00e9r\u00e9<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultat<\/h2>\n\n\n\n<p>La Cour a estim\u00e9 que, lorsque le mari de Mme Torres a inform\u00e9 Minto que Mme Torres et les enfants continueraient \u00e0 vivre dans le logement, il demandait en fait \u00e0 Minto de leur c\u00e9der le logement locatif. Lorsque Minto a demand\u00e9 \u00e0 Mme Torres de payer un loyer, Minto a consenti \u00e0 la cession de la location.
