BCGSEU (1999)"},"content":{"rendered":"\n<p>Cet appel concernait la validit\u00e9 des politiques sur le lieu de travail qui excluaient syst\u00e9matiquement les femmes de l&#8217;emploi.<\/p>\n\n\n\n<p>Le FAEJ, avec l&rsquo;implication d West Coast FAEJ, est intervenu devant la Cour supr\u00eame du Canada, en coalition avec:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Le R\u00e9seau d\u2019action des femmes handicap\u00e9es (RAFCH)<\/li><li>Le Congr\u00e8s du travail du Canada<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>Tawney Meiorin \u00e9tait une pompi\u00e8re au minist\u00e8re des For\u00eats de la Colombie-Britannique. Elle avait travaill\u00e9 dans le domaine pendant plus de deux ans et avait re\u00e7u des \u00e9valuations positives. Apr\u00e8s que le gouvernement a mis au point des tests de condition physique obligatoires, Mme Meiorin a \u00e9t\u00e9 cong\u00e9di\u00e9e malgr\u00e9 la r\u00e9ussite de tous les tests sauf un. Elle a d\u00e9pos\u00e9 un grief de cong\u00e9diement et a \u00e9t\u00e9 r\u00e9int\u00e9gr\u00e9e par l&rsquo;arbitre. La Cour d\u2019appel de la Colombie-Britannique a accueilli l\u2019appel du gouvernement. Le syndicat de Mme Meiorin a interjet\u00e9 appel de cette d\u00e9cision devant la Cour supr\u00eame du Canada.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ a soutenu que la discrimination syst\u00e9mique ne pouvait \u00eatre combattue qu&rsquo;en examinant les normes sous-jacentes qui fa\u00e7onnent les r\u00e8gles du lieu de travail. Afin de lutter contre la discrimination syst\u00e9mique et de refl\u00e9ter le nombre croissant de femmes qui travaillent, les employeurs doivent d\u00e9velopper des pratiques, y compris des normes et des tests qui refl\u00e8tent et prennent en compte avec pr\u00e9cision les int\u00e9r\u00eats, les besoins et la situation des femmes.<\/p>\n\n\n\n<p>Le FAEJ a \u00e9galement plaid\u00e9 en faveur de l&rsquo;adoption d&rsquo;un nouveau cadre unifi\u00e9 pour d\u00e9terminer si la discrimination \u00e9tait justifi\u00e9e, en mettant l&rsquo;accent sur la question de savoir si l&#8217;employeur pouvait d\u00e9montrer qu&rsquo;il ne pouvait pas \u00e9viter l&rsquo;impact discriminatoire sur l&rsquo;individu ou le groupe. Dans ce cas, le crit\u00e8re \u00e9tait discriminatoire et injustifi\u00e9. Il n&rsquo;a pas envisag\u00e9 les diff\u00e9rentes capacit\u00e9s entre les femmes et les hommes, et le gouvernement n&rsquo;a pas montr\u00e9 pourquoi le test \u00e9tait sp\u00e9cifiquement n\u00e9cessaire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultat<\/h2>\n\n\n\n<p>La Cour supr\u00eame du Canada a accueilli l&rsquo;appel et a r\u00e9int\u00e9gr\u00e9 Mme Meiorin \u00e0 son poste. La Cour a \u00e9galement adopt\u00e9 un cadre unifi\u00e9 pour l&rsquo;examen de la discrimination. La Cour a jug\u00e9 que les employeurs pouvaient justifier les normes en montrant que:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La norme servait un objectif rationnellement li\u00e9 \u00e0 l&rsquo;ex\u00e9cution du travail<\/li><li>La norme a \u00e9t\u00e9 adopt\u00e9e dans une conviction honn\u00eate et de bonne foi qu&rsquo;elle \u00e9tait n\u00e9cessaire pour atteindre des objectifs l\u00e9gitimes li\u00e9s au travail<\/li><li>La norme \u00e9tait raisonnablement n\u00e9cessaire \u00e0 la r\u00e9alisation de ce but l\u00e9gitime li\u00e9 au travail (c.-\u00e0-d.
