P.G. de l&rsquo;Ontario (1998)"},"content":{"rendered":"\n<p>Cette affaire concernait l&rsquo;abrogation de la loi de 1993 sur l&rsquo;\u00c9quit\u00e9 en mati\u00e8re d&#8217;emploi et l&rsquo;\u00e9quit\u00e9 et l&rsquo;\u00e9galit\u00e9 des chances sur le lieu de travail.<\/p>\n\n\n\n<p>Le FAEJ s&rsquo;est associ\u00e9e au R\u00e9seau d\u2019action des femmes handicap\u00e9es (RAFCH) pour intervenir devant la Cour d\u2019appel de l\u2019Ontario.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>En 1995, le gouvernement de l&rsquo;Ontario a adopt\u00e9 la <em><u>Job Quotas Repeal Act<\/u><\/em><em>, 1995 <\/em>(JQRA). Cette loi a abrog\u00e9 la <em><u>Employment Equity Act<\/u><\/em><em>, 1993 <\/em>(EEA), que le gouvernement pr\u00e9c\u00e9dent avait promulgu\u00e9e. L&rsquo;EEA a \u00e9t\u00e9 con\u00e7u pour promouvoir l&rsquo;\u00e9quit\u00e9 en mati\u00e8re d&#8217;emploi, en particulier pour les Autochtones, les personnes handicap\u00e9es, les personnes racialis\u00e9es et les femmes. Le Code des droits de la personne de l\u2019Ontario interdisait \u00e9galement la discrimination syst\u00e9mique en mati\u00e8re d\u2019emploi, mais exigeait des plaintes individuelles.<\/p>\n\n\n\n<p>&nbsp;Marilyn Ferrel et trois autres personnes ont demand\u00e9 une d\u00e9claration selon laquelle la JQRA \u00e9tait inconstitutionnelle, car elle violait leurs droits \u00e0 l&rsquo;\u00e9galit\u00e9 en vertu de l&rsquo;art.<a href=\"https:\/\/www.canada.ca\/en\/canadian-heritage\/services\/how-rights-protected\/guide-canadian-charter-rights-freedoms.html#a2f\">15 de la Chartre<\/a>. La Cour supr\u00eame de l&rsquo;Ontario a rejet\u00e9 leur demande et a donc interjet\u00e9 appel devant la Cour d&rsquo;appel de l&rsquo;Ontario.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ et le RAFCH ont soutenu que l&rsquo;\u00e9quit\u00e9 en mati\u00e8re d&#8217;emploi l\u00e9gif\u00e9r\u00e9e \u00e9tait n\u00e9cessaire pour donner effet au droit de ne pas subir de discrimination syst\u00e9mique. L&rsquo;abrogation de la EEA perp\u00e9tuerait la discrimination syst\u00e9mique en Ontario, particuli\u00e8rement en milieu de travail et dans le contexte de l&#8217;emploi. Les groupes prot\u00e9g\u00e9s par l&rsquo;EEA ont \u00e9t\u00e9 confront\u00e9s \u00e0 des obstacles, notamment des taux de ch\u00f4mage plus \u00e9lev\u00e9s, moins d&rsquo;options d&#8217;emploi, une r\u00e9mun\u00e9ration in\u00e9gale pour un travail \u00e9gal, le harc\u00e8lement sur le lieu de travail et la sous-repr\u00e9sentation aux cadres sup\u00e9rieurs. Le Code des droits de la personne, aussi fin soit-il, impose aux individus le fardeau de lutter contre la discrimination syst\u00e9mique et passe in\u00e9vitablement \u00e0 c\u00f4t\u00e9 de nombreuses causes sous-jacentes de la discrimination.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultat<\/h2>\n\n\n\n<p>La Cour d&rsquo;appel de l&rsquo;Ontario a statu\u00e9 que le Code des droits de la personne de l&rsquo;Ontario satisfaisait \u00e0 toute obligation du gouvernement de promulguer une loi pour lutter contre la discrimination syst\u00e9mique dans l&#8217;emploi, m\u00eame si elle ne pensait pas que le gouvernement avait une telle obligation.
