Platy Enterprises Lt\u00e9e (1989)\u00a0"},"content":{"rendered":"\n<p>Cette affaire concernait la question de savoir si le harc\u00e8lement sexuel \u00e9tait une discrimination sexuelle.<br><br>Le FAEJ est intervenu devant la Cour supr\u00eame du Canada.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Faits<\/h2>\n\n\n\n<p>Dianna Janzen et Tracy Govereau travaillaient dans un restaurant exploit\u00e9 par Platy Enterprises. Pendant qu&rsquo;ils travaillaient l\u00e0-bas, les deux ont \u00e9t\u00e9 harcel\u00e9s sexuellement et verbalement abus\u00e9s par un autre employ\u00e9 du restaurant.<\/p>\n\n\n\n<p>Mme Janzen et Mme Govereau ont d\u00e9pos\u00e9 une plainte aupr\u00e8s de la Commission des droits de la personne du Manitoba. L&rsquo;arbitre a conclu que les deux femmes avaient \u00e9t\u00e9 victimes de discrimination sexuelle en raison du harc\u00e8lement sexuel persistant et abusif auquel elles avaient \u00e9t\u00e9 confront\u00e9es et leur a accord\u00e9 des dommages-int\u00e9r\u00eats. La Cour du Banc de la Reine du Manitoba a ajust\u00e9 le montant des dommages-int\u00e9r\u00eats accord\u00e9s, mais a par ailleurs maintenu la d\u00e9cision. La Cour d&rsquo;appel du Manitoba a toutefois conclu que le harc\u00e8lement sexuel auquel les femmes avaient \u00e9t\u00e9 confront\u00e9es n&rsquo;\u00e9tait pas de la discrimination sexuelle et qu&rsquo;un employeur ne pouvait \u00eatre tenu responsable du harc\u00e8lement sexuel commis par un employ\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Argumentation<\/h2>\n\n\n\n<p>Le FAEJ a fait valoir que le harc\u00e8lement sexuel \u00e9tait une discrimination sexuelle et contribuait \u00e0 l&rsquo;in\u00e9galit\u00e9 des femmes. Il n&rsquo;est pas n\u00e9cessaire que toutes les femmes soient victimes de harc\u00e8lement sexuel pour qu&rsquo;il s&rsquo;agisse d&rsquo;une forme de discrimination sexuelle, car toutes les femmes peuvent potentiellement \u00eatre victimes de harc\u00e8lement sexuel en raison de leur appartenance \u00e0 un groupe consid\u00e9r\u00e9 comme des objets sexuels<\/p>\n\n\n\n<p>Le FAEJ a \u00e9galement fait valoir que les tribunaux devraient continuer d\u2019adopter une approche t\u00e9l\u00e9ologique de la l\u00e9gislation relative aux droits de l\u2019homme, qui les obligeait \u00e0 examiner l\u2019objet sous-jacent de la loi. Cela comprenait la protection des groupes d\u00e9favoris\u00e9s tels que les femmes. Le tribunal devait reconna\u00eetre que le sexe ne se limitait pas aux diff\u00e9rences biologiques, mais incorporait \u00e9galement des aspects sociaux, notamment l\u2019in\u00e9galit\u00e9 \u00e9conomique des femmes et leur exp\u00e9rience de subordination sexuelle.<\/p>\n\n\n\n<p>Le FAEJ a \u00e9galement soutenu que les employeurs \u00e9taient responsables du harc\u00e8lement sexuel perp\u00e9tr\u00e9 contre leurs employ\u00e9s par des employ\u00e9s de supervision.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9sultat<\/h2>\n\n\n\n<p>La Cour a estim\u00e9 que le harc\u00e8lement sexuel \u00e9tait une forme de discrimination sexuelle. Le harc\u00e8lement sexuel subi par les deux femmes a affect\u00e9 leurs conditions de travail et leurs possibilit\u00e9s d&#8217;emploi fond\u00e9es sur le sexe. La discrimination n&rsquo;exigeait pas que tous les membres d&rsquo;un groupe subissent le m\u00eame traitement.
