Ce projet triennal \u00e9tudie l\u2019efficacit\u00e9 de la gestion des pr\u00e9c\u00e9dents litiges du FAEJ et d\u00e9finit une strat\u00e9gie quinquennale pour aller plus loin.<\/p>\n\n\n\n<p>Dans le cadre de ce projet, FAEJ organisera une conf\u00e9rence de deux jours \u00e0 l&rsquo;automne 2020, qui r\u00e9unira des organisations communautaires, des universitaires et des d\u00e9fenseurs de l&rsquo;\u00e9galit\u00e9 des genres, autour de l\u2019usage de la loi dans la promotion de l&rsquo;\u00e9galit\u00e9 des genres. En appui de cette conf\u00e9rence, FAEJ mandate et finance trois projets de communication, qui fourniront aux participants du colloque des informations g\u00e9n\u00e9rales sur les sujets importants.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Descriptif<\/strong><\/h3>\n\n\n\n<p>Les projets de communication analyseront de mani\u00e8re exhaustive la litt\u00e9rature et les autres formats de connaissances disponibles sur un sujet donn\u00e9 (voir la liste des sujets ci-dessous). L&rsquo;auteur n&rsquo;est pas suppos\u00e9 mener les recherches originales. Il cr\u00e9era un document synth\u00e9tique, r\u00e9sumant l\u2019\u00e9tat des connaissances existantes \u00e0 ce jour.<\/p>\n\n\n\n<p>Les candidats retenus devront r\u00e9diger un rapport d\u2019une longueur ad\u00e9quate, \u00e0 vis\u00e9e de publication dans une revue universitaire. Ils devront \u00e9galement r\u00e9diger un r\u00e9sum\u00e9 de l&rsquo;article de 3 \u00e0 5 pages. Ensemble, ces deux documents constitueront le dossier d\u2019informations.<\/p>\n\n\n\n<p>Il est essentiel que le rapport et le r\u00e9sum\u00e9 soient r\u00e9dig\u00e9s dans un langage accessible, en \u00e9vitant le jargon universitaire et juridique et en reconnaissant que les lecteurs disposeront d&rsquo;une large gamme de connaissances pr\u00e9alables sur le sujet trait\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Sujets<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>1. Porter les arguments intersectionnels devant les tribunaux<\/strong><\/h4>\n\n\n\n<p>Ce document examinera l\u2019usage et l&rsquo;efficacit\u00e9 des arguments juridiques \u00e0 l\u2019aide d\u2019un cadre intersectionnel. Ce dernier comprendra, sans toutefois s&rsquo;y limiter&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La signification historique de l&rsquo;intersectionnalit\u00e9, y compris son rapport avec le f\u00e9minisme, l&rsquo;introduction et le r\u00f4le du f\u00e9minisme intersectionnel dans le cadre l\u00e9gal<\/li><li>Une synth\u00e8se des d\u00e9fis et des meilleures pratiques sugg\u00e9r\u00e9es dans la mise en \u0153uvre de l&rsquo;intersectionnalit\u00e9 et la pratique de la positionnalit\u00e9 au sein des alliances, en particulier dans le contexte de la d\u00e9fense des droits<\/li><li>Une discussion sur l\u2019usage des arguments juridiques intersectionnels au Canada et dans d\u2019autres juridictions similaires (Royaume-Uni, \u00c9tats-Unis, Afrique du Sud, Australie) et la preuve du poids de ces arguments sur les ultimes d\u00e9cisions juridiques<\/li><li>Une synth\u00e8se des id\u00e9es ou des strat\u00e9gies avanc\u00e9es pour inciter les tribunaux \u00e0 \u00e9couter les arguments juridiques fond\u00e9s sur un cadre intersectionnel ou \u00e0 utiliser un filtre intersectionnel dans leur propre analyse juridique<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>2. Utiliser le syst\u00e8me juridique pour promouvoir l&rsquo;\u00e9galit\u00e9 des femmes et des filles autochtones<\/strong><\/h4>\n\n\n\n<p>Ce document examinera l\u2019usage du syst\u00e8me juridique canadien pour promouvoir l&rsquo;\u00e9galit\u00e9 des femmes et des filles autochtones au Canada. Ce dernier comprendra, sans toutefois s&rsquo;y limiter&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Une synth\u00e8se des efforts pr\u00e9c\u00e9dents (r\u00e9ussites et \u00e9checs) visant \u00e0 utiliser les codes des droits de la personne, la D\u00e9claration des droits et la <em>Charte des droits et libert\u00e9s<\/em> afin de promouvoir l&rsquo;\u00e9galit\u00e9 des femmes et des filles autochtones au Canada<\/li><li>Une synth\u00e8se des recherches existantes sur les alliances des colons aux organisations et aux peuples autochtones (en particulier les femmes et les filles autochtones ou les organisations repr\u00e9sentant leurs int\u00e9r\u00eats), y compris toute recherche ax\u00e9e sur les partenariats impliquant la d\u00e9fense des droits des peuples autochtones via des structures l\u00e9gales coloniales<\/li><li>Un examen des d\u00e9fis \u00e0 venir concernant l\u2019usage d&rsquo;un syst\u00e8me juridique colonial, comme outil de d\u00e9fense des droits des peuples autochtones, ainsi qu&rsquo;une synth\u00e8se des approches conseill\u00e9es pouvant diminuer les pr\u00e9judices (intentionnels ou non) dans ce cadre.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>3. L&rsquo;\u00e9volution du paysage juridique canadien en mati\u00e8re de litiges relatifs aux droits \u00e0 l&rsquo;\u00e9galit\u00e9<\/strong><\/h4>\n\n\n\n<p>Ce document examinera l&rsquo;\u00e9volution du paysage juridique canadien, de 1985 \u00e0 nos jours, concernant les litiges sur les droits \u00e0 l&rsquo;\u00e9galit\u00e9.
