At trial, defence counsel argued that the complainant\u2019s evidence was unreliable, because her disability made her suggestible. The trial judge convicted the accused of sexually assaulting the complainant.<\/p>\n\n\n\n<p>The majority of the&nbsp;<a class=\"external\" href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2019\/2019onca807\/2019onca807.html?autocompleteStr=slatter&amp;autocompletePos=5\" target=\"_blank\" rel=\"noopener noreferrer\">Ontario Court of Appeal<\/a>&nbsp;overturned the conviction and ordered a new trial, finding the judge\u2019s reasons were not sufficient. In particular, the majority held that that the trial judge failed to address what they found to be a central issue: the complainant\u2019s reliability and suggestibility.<\/p>\n\n\n\n<p><span data-contrast=\"auto\">Stereotypes about women labelled with intellectual disabilities<\/span><span data-contrast=\"auto\">&nbsp;should not be used to&nbsp;<\/span><span data-contrast=\"auto\">justify imposing&nbsp;<\/span><span data-contrast=\"auto\">a<\/span><span data-contrast=\"auto\">&nbsp;more onerous standard when assessing the reliability of evidence of complainants labelled with intellectual and\/or developmental disabilities<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">in relation to their testimony&nbsp;<\/span><span data-contrast=\"auto\">in sexual assault cases.&nbsp; Doing so<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">will<\/span><span data-contrast=\"auto\">&nbsp;further silence the<\/span><span data-contrast=\"auto\">&nbsp;voices of these&nbsp;<\/span><span data-contrast=\"auto\">women<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">&nbsp;Such silencing is evident in the case under appeal. This has a deeply damaging impact on access to justice for women labelled with intellectual and\/or developmental disabilities. It is particularly troubling, given the high rates of s<\/span><span data-contrast=\"auto\">exual assault among women with disabilities.&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">\u00ab\u00a0This appeal is an important one for the LEAF-DAWN-ARCH coalition,\u201d says Megan Stephens, Executive Director and General Counsel of LEAF. \u201cBuilding on our past interventions in sexual assault appeals, our submissions will ensure that the Supreme Court appreciates&nbsp;<\/span><span data-contrast=\"auto\">how the imposition of a<\/span><b><span data-contrast=\"auto\">&nbsp;<\/span><\/b><span data-contrast=\"none\">more onerous standard when assessing the reliability of evidence of complainants<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">labelled with intellectual and\/or developmental disabilities&nbsp;<\/span><span data-contrast=\"auto\">can undermine&nbsp;<\/span><span data-contrast=\"auto\">their&nbsp;<\/span><span data-contrast=\"auto\">substantive equality rights<\/span><span data-contrast=\"auto\">.\u00a0\u00bb<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:254}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">\u201c<\/span><span data-contrast=\"auto\">Equality rights for women and girls with disabilities have not been won yet in Canad<\/span><span data-contrast=\"auto\">a<\/span><span data-contrast=\"auto\">,\u201d says Bonnie Brayton, Executive Director of DAWN.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">\u201c<\/span><span data-contrast=\"auto\">This case, which could substantially advance the concept of intersectional human rights as the desired framework, begins to move the courts and judicial system into the real world of victims of gender<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">based<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">violence, where intersecting identities place some women at higher risk of being a victim<\/span><span data-contrast=\"auto\">, and can also make them less likely to be believed<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:254}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">\u201cThere&nbsp;<\/span><span data-contrast=\"auto\">are<\/span><span data-contrast=\"auto\"> fundamental access to justice issues at stake for women with disabilities in this appeal,\u201d states Robert Lattanzio, Executive Director of ARCH. \u00ab\u00a0LEAF-DAWN-ARCH&rsquo;s intervention focuses on the role of generalizations and stereotypes about women labelled with intellectual and\/or developmental disabilities.
