She acted as a drug courier, importing 2 kg of cocaine into Canada, and then<\/span><span data-contrast=\"auto\">&nbsp;pleaded guilty to importing drugs<\/span><span data-contrast=\"auto\">.&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">As an Indigenous person, Ms. Sharma is entitled to the use of the&nbsp;<\/span><i><span data-contrast=\"auto\">Gladue<\/span><\/i><i><span data-contrast=\"auto\">&nbsp;<\/span><\/i><span data-contrast=\"auto\">framework<\/span><span data-contrast=\"auto\">. The&nbsp;<\/span><i><span data-contrast=\"auto\">Gladue<\/span><\/i><i><span data-contrast=\"auto\">&nbsp;<\/span><\/i><span data-contrast=\"auto\">framework is&nbsp;<\/span><span data-contrast=\"auto\">an individualized&nbsp;<\/span><span data-contrast=\"auto\">approach&nbsp;<\/span><span data-contrast=\"auto\">to sentencing that requires judges to consider the impact of&nbsp;<\/span><span data-contrast=\"auto\">systemic factors such as intergenerational trauma&nbsp;<\/span><span data-contrast=\"auto\">of<\/span><span data-contrast=\"auto\">&nbsp;residential schools and the harms of colonial oppression, and t<\/span><span data-contrast=\"auto\">o consider alternatives to incarceration when sentencing Indigenous offenders.<\/span><span data-contrast=\"auto\">&nbsp;These&nbsp;<\/span><span data-contrast=\"auto\">options&nbsp;<\/span><span data-contrast=\"auto\">include conditional sentences<\/span><span data-contrast=\"auto\">, a community-based alternative to a custodial sentence.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">However, 2012 amendments to the&nbsp;<\/span><i><span data-contrast=\"auto\">Criminal Code<\/span><\/i><i><span data-contrast=\"auto\">&nbsp;<\/span><\/i><span data-contrast=\"auto\">mad<\/span><span data-contrast=\"auto\">e<\/span><span data-contrast=\"auto\">&nbsp;conditional sentences unavailable for offences with a maximum penalty of 14 years or life in prison<\/span><span data-contrast=\"auto\">, and for offences involving the import, export, trafficking, or production of drugs, with a maximum penalty of 10 years in prison<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">As a result, Ms. Sharma was not eligible for a conditional sentence.&nbsp;<\/span><span data-contrast=\"auto\">Ms. Sharma argued that the provisions violated her rights under section<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">15 of the&nbsp;<\/span><i><span data-contrast=\"auto\">Charter<\/span><\/i><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">&nbsp;but the trial judge did not&nbsp;<\/span><span data-contrast=\"auto\">accept&nbsp;<\/span><span data-contrast=\"auto\">these<\/span><span data-contrast=\"auto\">&nbsp;arguments<\/span><span data-contrast=\"auto\">&nbsp;and imposed a custodial sentence<\/span><span data-contrast=\"auto\">.&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">LEAF and the Asper Centre intervened<\/span><span data-contrast=\"auto\">&nbsp;before the Ontario Court of Appeal<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">to argue that the constitutionality of the provisions needed to be assessed in the context of systemic discrimination against Indigenous people<\/span><span data-contrast=\"auto\">, especially Indigenous women, in the administration of criminal justice<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">This discrimination is clearly evident in the&nbsp;overwhelming&nbsp;overinca<\/span><span data-contrast=\"auto\">rceration of Indigenous people, particularly Indigenous women, in Canada.&nbsp;<\/span><span data-contrast=\"auto\">In 2017\/2018, Indigenous persons represented approximately four percent of the adult population in Canada, but accounted for 30 percent of admissions to provincial or territorial custody, and 28 percent of admissions to federal custody.<\/span><span data-contrast=\"auto\">&nbsp;The crisis of&nbsp;overincarceration has worsened&nbsp;over&nbsp;time. Between 2007\/2008<\/span><span data-contrast=\"auto\">&nbsp;and 2017\/2018<\/span><span data-contrast=\"auto\">, for example, the number of admissions of Indigenous women to provincial\/territorial custody<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">increased by 66 percent.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">The&nbsp;<\/span><span data-contrast=\"auto\">majority\u2019s&nbsp;<\/span><span data-contrast=\"auto\">decision&nbsp;<\/span><span data-contrast=\"auto\">means that conditional sentences will now be an available option&nbsp;<\/span><span data-contrast=\"auto\">for trial judges to consider in sentencing&nbsp;<\/span><span data-contrast=\"auto\">Indigenous offenders<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">for a wide variety of offences<\/span><span data-contrast=\"auto\">, provided other requirements<\/span><span data-contrast=\"auto\">&nbsp;are also met<\/span><span data-contrast=\"auto\">&nbsp;(including that th<\/span><span data-contrast=\"auto\">e sentence is less than two years, and serving the sentence in the community will not endanger the community)<\/span><span data-contrast=\"auto\">.&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">Ms. Sharma will not get to see the direct benefit of her victory, having already served&nbsp;<\/span><span data-contrast=\"auto\">her&nbsp;<\/span><span data-contrast=\"auto\">jail<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">sentence before th<\/span><span data-contrast=\"auto\">e<\/span><span data-contrast=\"auto\">&nbsp;appeal.&nbsp;<\/span><span data-contrast=\"auto\">T<\/span><span data-contrast=\"auto\">h<\/span><span data-contrast=\"auto\">e decision, however,<\/span><span data-contrast=\"auto\">&nbsp;will<\/span><span data-contrast=\"auto\">&nbsp;help to ensure that<\/span><span data-contrast=\"auto\">, moving forward,<\/span><span data-contrast=\"auto\">&nbsp;Indigenous offenders receive the benefit of the different approach to sentencing enshrined in the&nbsp;<\/span><i><span data-contrast=\"auto\">Gladue<\/span><\/i><i><span data-contrast=\"auto\">&nbsp;<\/span><\/i><span data-contrast=\"auto\">framework<\/span><span data-contrast=\"auto\">. It will also&nbsp;<\/span><span data-contrast=\"auto\">serve as a small step towards reducing the&nbsp;overincarceration of Indigenous people and in particular Indigenous women.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">The&nbsp;<\/span><span data-contrast=\"auto\">majority\u2019s&nbsp;<\/span><span data-contrast=\"auto\">decision&nbsp;<\/span><span data-contrast=\"auto\">represents an important articulation of substantive equality under section 15 of the&nbsp;<\/span><i><span data-contrast=\"auto\">Charter<\/span><\/i><span data-contrast=\"auto\">. Section 15, despite its potential for advancing equ<\/span><span data-contrast=\"auto\">ality, remains complex and under<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">applied. The majority\u2019s analysis provides a<\/span><span data-contrast=\"auto\">&nbsp;clear<\/span><span data-contrast=\"auto\">&nbsp;example of how<\/span><span data-contrast=\"auto\">&nbsp;to apply<\/span><span data-contrast=\"auto\">&nbsp;section 15 where a<\/span><span data-contrast=\"auto\">n applicant argues that a law appearing neutral on its face is discriminatory in its effect<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">&nbsp;and illustrates the potential of section 15 to be used as tool for addressing the&nbsp;overincarceration of Indigenous people, and Indigenous women in particular.&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">\u201cWe are extreme<\/span><span data-contrast=\"auto\">ly pleased with the decision in&nbsp;<\/span><i><span data-contrast=\"auto\">R. v.
