Colucci&nbsp;<\/span><\/i><span data-contrast=\"auto\">at<\/span><span data-contrast=\"auto\">&nbsp;the Supreme Court of Canad<\/span><span data-contrast=\"auto\">a<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">In our factum,&nbsp;<\/span><span data-contrast=\"auto\">LEAF and West Coast LEAF, represented by Jennifer Klinck and Joshua Sealy-Harrington (Power Law),&nbsp;<\/span><span data-contrast=\"auto\">propose<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">a&nbsp;<\/span><span data-contrast=\"auto\">legal framework for child support orders that takes as its starting point the reality that unpaid child support contributes to the feminization of poverty.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">The feminization of poverty is a term&nbsp;<\/span><span data-contrast=\"auto\">for<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">the economic disadvantages<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">faced by women that<\/span><span data-contrast=\"auto\">&nbsp;are<\/span><span data-contrast=\"auto\">&nbsp;both the result of and are<\/span><span data-contrast=\"auto\">&nbsp;perpetuated by systemic discrimination.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">By centering women and children\u2019s substantive equality rights, the framework<\/span><span data-contrast=\"auto\">&nbsp;that we propose<\/span><span data-contrast=\"auto\">&nbsp;would ensure that judges\u2019 child support orders<\/span><span data-contrast=\"auto\">&nbsp;are fair<\/span><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><b><span data-contrast=\"auto\">Case background<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:1,&quot;335551620&quot;:1,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">&nbsp;<\/span><\/h3>\n\n\n\n<p><span data-contrast=\"auto\">This case, on appeal from Ontario, is about a father who<\/span><span data-contrast=\"auto\">&nbsp;\u2013&nbsp;<\/span><span data-contrast=\"auto\">over&nbsp;<\/span><span data-contrast=\"auto\">16 years<\/span><span data-contrast=\"auto\">&nbsp;\u2013&nbsp;<\/span><span data-contrast=\"auto\">chronicall<\/span><span data-contrast=\"auto\">y<\/span><span data-contrast=\"auto\">&nbsp;underpaid child support to a mother, resulting in a debt of over&nbsp;<\/span><span data-contrast=\"auto\">$170,000. During that time, the father failed to disclose his income, rarely made voluntary support payments, and absconded twice without notice to his family or the Family Responsibility Office overseeing his support\u2014first to the United States, and then to Italy. After his children no longer qualified for ongoing support because they were grown, the father applied to substantially rescind his debt. The Superior Court of Justice granted the father a retroactive reduction in child support arrears, reducing his debt to $41,642.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">The&nbsp;<\/span><a href=\"http:\/\/canlii.ca\/t\/j19lg\"><span data-contrast=\"none\">Court of Appeal for Ontario<\/span><\/a><span data-contrast=\"auto\">&nbsp;overturned this decision for failing to apply a 2006 Supreme Court decision,&nbsp;<\/span><a href=\"http:\/\/canlii.ca\/t\/1p0tv\"><i><span data-contrast=\"none\">DBS v. SRG<\/span><\/i><\/a><span data-contrast=\"auto\">, which involved retroactive&nbsp;<\/span><span data-contrast=\"auto\">increases<\/span><span data-contrast=\"auto\">&nbsp;of child support obligations. The Court of Appeal for Ontario decided that&nbsp;<\/span><i><span data-contrast=\"auto\">DBS&nbsp;<\/span><\/i><span data-contrast=\"auto\">should apply to applications<\/span><span data-contrast=\"auto\">&nbsp;like the one that Mr. Colucci made<\/span><span data-contrast=\"auto\">&nbsp;as well<\/span><span data-contrast=\"auto\">, which was an application<\/span><span data-contrast=\"auto\">&nbsp;for&nbsp;<\/span><span data-contrast=\"auto\">a&nbsp;<\/span><span data-contrast=\"auto\">retroactive&nbsp;<\/span><span data-contrast=\"auto\">decrease<\/span><span data-contrast=\"auto\">&nbsp;of child support obligations<\/span><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">The Supreme Court of Canada will have the last word on whether this&nbsp;<\/span><span data-contrast=\"auto\">decision<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">by the Court of Appeal for Ontario was correct<\/span><span data-contrast=\"auto\">. In&nbsp;<\/span><span data-contrast=\"auto\">doing so<\/span><span data-contrast=\"auto\">, it will decide the factors that should be taken into account when&nbsp;<\/span><span data-contrast=\"auto\">a judge is deciding whether to retroactively reduce, or retroactively increase, the child support that someone owes<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:1,&quot;335551620&quot;:1,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><b><span data-contrast=\"auto\">LEAF &amp; West Coast LEAF\u2019s&nbsp;<\/span><\/b><b><span data-contrast=\"auto\">argument<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">&nbsp;<\/span><\/h3>\n\n\n\n<p><span data-contrast=\"auto\">LEAF&nbsp;<\/span><span data-contrast=\"auto\">and<\/span><span data-contrast=\"auto\">&nbsp;West Coast LEAF have intervened in this case to provide the Supreme Court with an accura<\/span><span data-contrast=\"auto\">te picture of how child support i<\/span><span data-contrast=\"auto\">s paid (or not paid)<\/span><span data-contrast=\"auto\">&nbsp;across Canada<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">T<\/span><span data-contrast=\"auto\">he reality is that child support is dramatically u<\/span><span data-contrast=\"auto\">nderpaid and overwhelmingly gendered<\/span><span data-contrast=\"auto\">.&nbsp;<\/span><span data-contrast=\"auto\">The economic destinies of women and children are intertwined<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">&nbsp;as most children continue to live with their mothers.&nbsp;<\/span><span data-contrast=\"auto\">In the vast majority of cases, it is the father who is supposed to pay child support to the mother, and it is the father who fails to do so<\/span><span data-contrast=\"auto\">.&nbsp;<\/span><span data-contrast=\"auto\">Our intervention also highlights<\/span><span data-contrast=\"auto\">&nbsp;the<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">interconnectedness of&nbsp;<\/span><span data-contrast=\"auto\">child support and intimate partner violence<\/span><span data-contrast=\"auto\">; i<\/span><span data-contrast=\"auto\">n abusive relationships, financial&nbsp;<\/span><span data-contrast=\"auto\">abuse&nbsp;<\/span><span data-contrast=\"auto\">and threats are often present<\/span><span data-contrast=\"auto\">.&nbsp;<\/span><span data-contrast=\"auto\">Given all this<\/span><span data-contrast=\"auto\">, every unpaid child support instalment both contributes to women\u2019s socioeconomic inequality and deepens child poverty.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><span data-contrast=\"auto\">\u201c<\/span><span data-contrast=\"auto\">Court decisions do not take place in a vacuum<\/span><span data-contrast=\"auto\">,\u201d says Megan Stephens, Executive Director and General Counsel of LEAF. \u201c<\/span><span data-contrast=\"auto\">Court<\/span><span data-contrast=\"auto\">s need to understand the&nbsp;<\/span><span data-contrast=\"auto\">realities&nbsp;<\/span><span data-contrast=\"auto\">of child support&nbsp;<\/span><span data-contrast=\"auto\">underpayment&nbsp;<\/span><span data-contrast=\"auto\">to better appreciate how&nbsp;<\/span><span data-contrast=\"auto\">vary<\/span><span data-contrast=\"auto\">ing<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">someone\u2019s&nbsp;<\/span><span data-contrast=\"auto\">outstanding&nbsp;<\/span><span data-contrast=\"auto\">child support debt&nbsp;<\/span><span data-contrast=\"auto\">may<\/span><span data-contrast=\"auto\">&nbsp;further exacerbate women<\/span><span data-contrast=\"auto\">\u2019s<\/span><span data-contrast=\"auto\">&nbsp;and children\u2019s economic marginalization.<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p><p><span data-contrast=\"auto\">\u201c<\/span><span data-contrast=\"auto\">Unpaid child support has<\/span><span data-contrast=\"auto\">&nbsp;a direct impact on the economic disadvantages faced by women, disadvantages that are perpetuated by structural and systemic discrimination<\/span><span data-contrast=\"auto\">,\u201d says&nbsp;<\/span><span data-contrast=\"auto\">Kate Feeney, Director of Litigation at West Coast LEAF.<\/span><span data-contrast=\"auto\"> &nbsp;<\/span><span data-contrast=\"auto\">\u201c<\/span><span data-contrast=\"auto\">This<\/span><span data-contrast=\"auto\">&nbsp;continues&nbsp;<\/span><span data-contrast=\"auto\">to<\/span><span data-contrast=\"auto\">&nbsp;contribute to<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">the&nbsp;<\/span><span data-contrast=\"auto\">feminization of poverty<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p><\/blockquote>\n\n\n\n<p><span data-contrast=\"auto\">LEAF and West Coast LEAF have proposed a simple framework to the Court that will allow&nbsp;<\/span><span data-contrast=\"auto\">judges<\/span><span data-contrast=\"auto\">&nbsp;to take women and children\u2019s substantive equality into account each time&nbsp;<\/span><span data-contrast=\"auto\">they are asked to&nbsp;<\/span><span data-contrast=\"auto\">retroactively&nbsp;<\/span><span data-contrast=\"auto\">modify a child support order.
