The coalition&nbsp;consisting&nbsp;of LEAF,&nbsp;DisAbled&nbsp;Women\u2019s Network Canada (DAWN), and ARCH Disability Law Centre (ARCH) are&nbsp;<a href=\"https:\/\/www.leaf.ca\/wp-content\/uploads\/2020\/07\/SCC-38870-Factum-of-the-Interveners-LEAF-DAWN-and-ARC-Suitable-for-Posting.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">intervening<\/a>&nbsp;in the appeal to highlight how&nbsp;substantive equality requires the court to assess a complainant\u2019s reliability based on her own conduct and capacity on the stand, as opposed to generalizations and stereotypes about her disability.&nbsp;&nbsp;<\/p>\n\n\n\n<p>This case is about&nbsp;a woman labelled with an intellectual disability who disclosed sexual assault. At trial,&nbsp;defence&nbsp;counsel argued the complainant&nbsp;was unreliable, because&nbsp;her intellectual disability made her suggestible \u2013&nbsp;meaning&nbsp;that she&nbsp;was easily influenced by suggestions made by others. The trial judge did not accept these submissions, and convicted the accused of sexually assaulting the complainant.&nbsp;<\/p>\n\n\n\n<p>The accused appealed to the Court of Appeal and argued, in part, that the judge&nbsp;did not provide sufficient reasons&nbsp;explaining&nbsp;why he found the complainant reliable.\u202fThe&nbsp;majority of the\u202f<a href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/2019\/2019onca807\/2019onca807.html?autocompleteStr=slatter&amp;autocompletePos=5\" target=\"_blank\" rel=\"noreferrer noopener\">Court of Appeal\u202ffor Ontario<\/a>&nbsp;overturned&nbsp;the conviction and ordered a new trial, finding that the judge\u2019s reasons were not sufficient.&nbsp;The majority&nbsp;focused on the expert report from the trial that discussed the complainant\u2019s suggestibility&nbsp;in relation to that of the general population, and held that the trial judge failed to adequately address the issue of the complainant\u2019s reliability and suggestibility in his reasons.&nbsp;<\/p>\n\n\n\n<p>LEAF-DAWN-ARCH\u00a0will\u00a0argue that a substantive equality analysis requires the Court to make assessments\u00a0of reliability\u00a0based on the actual abilities and individual circumstances of women with disabilities (such as their ability to describe what happened).\u00a0By preferring the expert\u2019s generalized evidence\u00a0over the complainant\u2019s testimony, the majority\u2019s approach could require trial judges in future cases to\u00a0assess\u00a0the suggestibility of any\u00a0complainant labelled with an intellectual disability\u00a0regardless of their actual capacity.\u00a0This would effectively create a different and heightened standard for complainants labelled with\u00a0intellectual disabilities,\u00a0even when\u00a0there is no evidence of a complainant being suggestible during their interaction with law enforcement when they report, or at trial.\u00a0<\/p>\n\n\n\n<p>\u00ab\u00a0Substantive equality demands that complainants in the criminal justice system have their evidence evaluated based on their testimony &#8211; and not based on stereotypes, generalizations, or even unconscious biases about those labelled with intellectual disabilities,\u00a0\u00bb says Megan Stephens, Executive Director and General Counsel of LEAF.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u00ab\u00a0I am highly troubled by the systemic ableism in the justice system that acts as a barrier to complainants with disabilities having their evidence assessed on the same standard as others,\u201d says Bonnie Brayton, Executive Director of DAWN. \u201cWhile the Supreme Court&rsquo;s decision in&nbsp;<a href=\"https:\/\/www.leaf.ca\/r-v-d-a-i\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>D.A.I.<\/em><\/a><em>&nbsp;<\/em>[in 2012]&nbsp;sent a welcome message to women with disabilities that they can tell their stories in court about the abuse they experience, this decision suggests that they will face additional hurdles when they do so.\u00a0\u00bb&nbsp;<\/p>\n\n\n\n<p>\u201cAbleist&nbsp;generalizations about women labelled with intellectual disabilities&nbsp;create&nbsp;additional barriers to justice;&nbsp;women must overcome those generalizations in order to be found to be reliable witnesses.&nbsp;Consequently, women with disabilities&nbsp;may be more reluctant to report sexual assault for fear that their testimony will not be believed or that&nbsp;medical and&nbsp;sensitive&nbsp;information about their disability&nbsp;will become public.&nbsp;This case presents an important opportunity to guard against harmful stereotypes and promote equal access to justice for sexual assault complainants labelled with intellectual disabilities,\u201d says Robert Lattanzio, Executive Director of ARCH Disability Law Centre.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The hearing at the Supreme Court will take place on November 6<sup>th<\/sup>\u00a0at 9:30am EST, which can be viewed by live webcast\u00a0<a href=\"https:\/\/scc-csc.ca\/case-dossier\/info\/webcast-webdiffusion-eng.aspx?cas=38870\">here<\/a>.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Case committee and Counsel&nbsp;<\/h2>\n\n\n\n<p>LEAF-DAWN-ARCH\u2019s arguments were informed and supported by a case committee composed of academics and practitioners with expertise in the relevant issues.
