Slatter"},"content":{"rendered":"\n<p>November 16, 2020&nbsp;&nbsp;<\/p>\n\n\n\n<p>The LEAF-DAWN-ARCH Coalition welcomes the Supreme Court of Canada\u2019s recognition&nbsp;that generalizations and stereotypes about&nbsp;women with&nbsp;disabilities are \u201cinimical\u201d to the truth-finding process of a sexual assault trial in&nbsp;<em>R. v. Slatter<\/em>.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>On November 6, 2020, the Supreme Court of Canada issued a&nbsp;unanimous&nbsp;ruling from the Bench, in which the&nbsp;Court&nbsp;restored&nbsp;the&nbsp;sexual assault conviction&nbsp;for the accused.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The coalition is especially pleased the Court adopted the key points&nbsp;<a href=\"https:\/\/www.leaf.ca\/wp-content\/uploads\/2020\/07\/SCC-38870-Factum-of-the-Interveners-LEAF-DAWN-and-ARC-Suitable-for-Posting.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">advanced by the coalition<\/a>&nbsp;in its judgment&nbsp;by&nbsp;highlighting how&nbsp;\u201c[o]ver-reliance on generalities can perpetuate harmful myths and stereotypes about individuals with disabilities, which is inimical to the truth-seeking process, and creates additional barriers for those seeking access to justice.\u201d Substantive equality requires courts to assess evidence based on the actual abilities and individual circumstances of women with disabilities.&nbsp;<\/p>\n\n\n\n<p>While the Court\u2019s statement denouncing&nbsp;ableist&nbsp;stereotypes is a welcome&nbsp;one, it is disappointing that the Court did not&nbsp;explicitly&nbsp;recognize the gendered impact of sexual violence against women and girls with disabilities. As&nbsp;LEAF-DAWN-ARCH&nbsp;noted in&nbsp;the&nbsp;<a href=\"https:\/\/www.leaf.ca\/wp-content\/uploads\/2020\/07\/SCC-38870-Factum-of-the-Interveners-LEAF-DAWN-and-ARC-Suitable-for-Posting.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">written submissions<\/a>, women with disabilities are overrepresented among sexual assault survivors. In 2014,&nbsp;women living with disabilities were&nbsp;nearly twice as likely to have been sexually assaulted than women without disabilities.&nbsp;<\/p>\n\n\n\n<p>Suzan Fraser, co-counsel for LEAF-DAWN-ARCH, said in an interview with the&nbsp;<a href=\"https:\/\/www.theglobeandmail.com\/canada\/article-sexual-assault-testimonies-of-intellectually-disabled-should-be-judged\/\" target=\"_blank\" rel=\"noreferrer noopener\">Globe and Mail<\/a>&nbsp;about the case: \u201cjust because a person is labelled with a disability, we should be wary of treating their reliability differently based on what I would say are actuarial scores.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>Read the&nbsp;<a href=\"https:\/\/decisions.scc-csc.ca\/scc-csc\/scc-csc\/en\/item\/18541\/index.do\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court of Canada\u2019s decision<\/a>.&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Case committee and Counsel<\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p>LEAF-DAWN-ARCH\u2019s arguments were informed and supported by a case committee composed of academics and practitioners with expertise in the relevant issues.
