{"id":18555,"date":"2021-02-09T10:55:09","date_gmt":"2021-02-09T15:55:09","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=news&#038;p=18555"},"modified":"2021-02-09T10:55:10","modified_gmt":"2021-02-09T15:55:10","slug":"pronoun-use-and-british-columbia-courts-practice-directions","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/pronoun-use-and-british-columbia-courts-practice-directions\/","title":{"rendered":"LEAF Statement on Pronoun Use and British Columbia Courts Practice Directions"},"content":{"rendered":"\n<p>February 9, 2021<\/p>\n\n\n\n<p>LEAF applauds\u00a0the recent practice directions introduced by\u00a0British Columbia\u2019s\u00a0<a href=\"https:\/\/www.bccourts.ca\/supreme_court\/practice_and_procedure\/practice_directions\/civil\/PD-59_Forms_of_Address_for_Parties_and_Counsel_in_Proceedings.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme\u00a0<\/a>and\u00a0<a href=\"https:\/\/www.provincialcourt.bc.ca\/downloads\/Practice%20Directions\/NP%2024%20Form%20of%20Address%20for%20Parties%20and%20Lawyers.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Provincial\u00a0<\/a>courts, which direct lawyers and\u00a0parties\u00a0as\u00a0to how to advise\u00a0judicial officers, other parties, and lawyers of their\u00a0pronouns\u00a0and salutations.\u00a0Too often, institutional actors \u2013 in schools, in hospitals, in prisons, and certainly in courtrooms \u2013 see a person\u2019s gender identity as a triable issue, rather than as a basic human right.\u00a0With these new procedures, the B.C. courts have contributed to easing the discomfort that trans and gender non-conforming people experience with disturbing regularity in institutional spaces.\u00a0\u00a0<\/p>\n\n\n\n<p>LEAF has not been immune to the urge to put a person\u2019s gender identity on trial. In fact, LEAF\u2019s mandate still does not explicitly include&nbsp;many&nbsp;who face gender-based discrimination. This is a fact that we are working to change.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The criticism of the practice directions&nbsp;received much attention this weekend \u2013 we support the messages of&nbsp;all those who&nbsp;name&nbsp;transphobia in the legal community, and&nbsp;demand we do better.&nbsp;Canada\u2019s legal spaces have traditionally been hostile to all forms of difference; it is up to all of us to ensure that&nbsp;all&nbsp;participants&nbsp;recognize and respect&nbsp;the human rights and&nbsp;dignity&nbsp;of everyone who comes into contact with&nbsp;our legal systems.&nbsp;&nbsp;<\/p>\n\n\n\n<p>We\u00a0hope that all other\u00a0jurisdictions will adopt these types of\u00a0directions\u00a0as soon as possible.\u00a0At LEAF, we will\u00a0do the\u00a0work our organization\u00a0needs so that our advocacy is\u00a0inclusive\u00a0of all those facing gender-based discrimination.<\/p>\n","protected":false},"featured_media":0,"template":"","meta":{"_acf_changed":false},"categories":[],"tags":[492,342,368,493],"class_list":["post-18555","news","type-news","status-publish","hentry","tag-gender-identity","tag-human-rights","tag-inclusion","tag-trans-rights"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.1.1 -
