{"id":18584,"date":"2021-03-05T13:18:21","date_gmt":"2021-03-05T18:18:21","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=news&#038;p=18584"},"modified":"2021-03-05T13:28:27","modified_gmt":"2021-03-05T18:28:27","slug":"statement-conviction-toronto-van-attacker","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/statement-conviction-toronto-van-attacker\/","title":{"rendered":"LEAF Statement on the Conviction of the Toronto Van Attacker"},"content":{"rendered":"\n<p>March&nbsp;5, 2021&nbsp;<\/p>\n\n\n\n<p>On Wednesday, March 3,&nbsp;Justice Anne Molloy&nbsp;broadcast&nbsp;her&nbsp;<a href=\"https:\/\/www.ontariocourts.ca\/decisions\/2021ONSC1258.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a>&nbsp;over YouTube in the Ontario Superior Court of Justice&nbsp;trial&nbsp;of&nbsp;the&nbsp;man&nbsp;who killed 10 people and injured 16 on Yonge Street near Finch Avenue in Toronto on&nbsp;April 23, 2018.&nbsp;&nbsp;<\/p>\n\n\n\n<p>LEAF adopts Justice Molloy\u2019s use of the name \u201cJohn Doe\u201d&nbsp;in referring to the attacker, to stem the glorification of those who commit mass murder.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Justice Molloy convicted Doe&nbsp;of&nbsp;10 counts of first-degree murder and 16 counts of attempted murder for the&nbsp;incident, in which he struck people walking on the sidewalk with a rented van.&nbsp;Eight women and two men died in the attack:&nbsp;Anne Marie D&rsquo;Amico, 30, Dorothy Sewell, 80,&nbsp;Renuka&nbsp;Amarasingha, 45,&nbsp;Munir&nbsp;Najjar, 85,&nbsp;Chul&nbsp;Min (Eddie) Kang, 45, Mary Elizabeth (Betty) Forsyth, 94,&nbsp;Sohe&nbsp;Chung, 22, Andrea&nbsp;Bradden, 33, Geraldine&nbsp;Brady, 83, and Ji Hun Kim, 22.&nbsp;This was, and continues to be, the deadliest mass murder in Toronto\u2019s history.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Doe&nbsp;admitted to&nbsp;planning and conducting the van attack.&nbsp;&nbsp;He&nbsp;argued, however,&nbsp;that his&nbsp;Autism&nbsp;Spectrum&nbsp;Disorder impeded his ability to understand the wrongfulness of his act, and that he should therefore be held not criminally responsible.&nbsp;Justice Molloy accepted that Doe is on the autism spectrum,&nbsp;but decided that his Autism Spectrum Disorder&nbsp;did not impact his ability to know that his actions were&nbsp;legally or&nbsp;morally wrong.&nbsp;For this reason, Justice Molloy&nbsp;found Doe guilty.&nbsp;&nbsp;<\/p>\n\n\n\n<p>LEAF wishes to voice its solidarity with disability rights groups, and in particular autism advocacy organizations, who have consistently&nbsp;<a href=\"https:\/\/www.casda.ca\/statement-by-casda-social-acceptance-and-mental-health-at-play-in-minassian-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">expressed concerns<\/a>&nbsp;that Doe\u2019s reliance on his Autism Spectrum Disorder as a defence will increase stigmatization of autism at a time when Autistic individuals already face significant stigma that creates barriers to meaningful participation in society.&nbsp;As&nbsp;Autism Canada&nbsp;<a href=\"https:\/\/autismcanada.org\/in-response-to-the-recent-guilty-verdict-in-the-alek-minassian-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>&nbsp;following Justice Molloy\u2019s decision, \u201cPeople on the&nbsp;Autism&nbsp;Spectrum are&nbsp;far more likely to be victims of violence than perpetrators of it.\u201d&nbsp;<\/p>\n\n\n\n<p>In a police interrogation after the attack,&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/2019\/sep\/27\/alek-minassian-toronto-van-attack-interview-incels\" target=\"_blank\" rel=\"noreferrer noopener\">Doe&nbsp;told police<\/a>&nbsp;that his&nbsp;motive for this mass murder&nbsp;was his hatred of women, and his hatred of a society that produces sexually frustrated men like himself. These are the pillars of the&nbsp;\u201cinvoluntary celibate\u201d or&nbsp;\u201cincel\u201d subculture, an online subculture&nbsp;of men that organizes itself around&nbsp;violently misogynist&nbsp;views of&nbsp;women, as well as&nbsp;the glorification of&nbsp;violence against women and society at large.&nbsp;Doe&nbsp;told police that he was \u201cradicalized\u201d around the time of&nbsp;the&nbsp;2014 killings of six people in California.&nbsp;The person who carried out those attacks&nbsp;described himself&nbsp;as&nbsp;an&nbsp;incel&nbsp;and wrote a manifesto encouraging mass murder as a means of overthrowing what he perceived to be&nbsp;women\u2019s domination of society.&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/2019\/sep\/27\/alek-minassian-toronto-van-attack-interview-incels\" target=\"_blank\" rel=\"noreferrer noopener\">Doe&nbsp;reportedly&nbsp;began to fantasize<\/a>&nbsp;about his own \u201crebellion\u201d, and told the police that he was hoping his van attack would \u201cinspire future masses to join me in my uprising as well.\u201d&nbsp;<\/p>\n\n\n\n<p>Justice Molloy, however, agreed with expert testimony that the&nbsp;incel&nbsp;movement&nbsp;was not Doe\u2019s&nbsp;primary&nbsp;motivation for the attack. Rather, this was a lie that he told to the police. Instead, Doe&nbsp;was a lonely and hopeless person&nbsp;wishing for fame who \u201cpiggybacked on the&nbsp;incel&nbsp;movement to ratchet up his own notoriety.\u201d&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>While Doe\u2019s attack&nbsp;may&nbsp;not&nbsp;ultimately&nbsp;have been motivated by violent misogyny, subcultures of&nbsp;gender-based&nbsp;hate played a central role in this&nbsp;event.&nbsp;Whether Doe sincerely believed&nbsp;in&nbsp;incel&nbsp;ideology or not, he was inspired and radicalized by&nbsp;the&nbsp;misogynist killings&nbsp;in California&nbsp;by virtue of online spaces where misogynist violence&nbsp;is openly discussed and encouraged.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>In addition, Doe actively declared his attack&nbsp;to be a part of the&nbsp;incel&nbsp;movement on his Facebook page and in other online spaces.&nbsp;His choice to link his attacks to&nbsp;incel&nbsp;ideology led&nbsp;other&nbsp;incels&nbsp;to glorify Doe\u2019s actions&nbsp;by posting&nbsp;statements such as,&nbsp;\u00ab\u00a0It&rsquo;s a good time to be an&nbsp;incel. Our brothers are launching their counter-attack, getting their revenge.\u00a0\u00bb&nbsp;<\/p>\n\n\n\n<p>The fact that Doe&nbsp;used&nbsp;the California&nbsp;killings as a blueprint for his own is a stark example of the significant harms caused by gender-based online hate speech. The&nbsp;celebration of Doe\u2019s actions as being part of the&nbsp;incel&nbsp;movement is&nbsp;a&nbsp;further&nbsp;example&nbsp;of&nbsp;technology-facilitated&nbsp;violence&nbsp;against women and gender-diverse people.&nbsp;&nbsp;<\/p>\n\n\n\n<p>LEAF recommends that a regulatory mechanism be developed to address these harms and to hold social media platforms to account.\u202fRegulatory measures are&nbsp;being&nbsp;considered or are in place in several foreign jurisdictions, and are supported by the UN Special Rapporteur on Violence Against Women.&nbsp;It is untenable to allow profit-making, algorithmically driven entities to continue unregulated when we see the direct effect of&nbsp;online misogyny in the views&nbsp;published online by perpetrators of mass killings, such as the Toronto van attack in 2018 or the 2014 murders&nbsp;in California.&nbsp;<\/p>\n\n\n\n<p>Doe\u2019s resentment towards women,&nbsp;a factor in the attack&nbsp;though not the driving force,&nbsp;calls&nbsp;up&nbsp;the&nbsp;misogynist&nbsp;mass shooting in\u202f<a href=\"https:\/\/www.cbc.ca\/news\/canada\/nova-scotia\/photos-nova-scotia-shooting-victims-1.5538364\" target=\"_blank\" rel=\"noreferrer noopener\">Nova Scotia<\/a>&nbsp;in April&nbsp;18 and 19&nbsp;2020. This shooting&nbsp;began with&nbsp;that killer\u2019s&nbsp;abuse of his female partner and ended in the killing of 22 people. The link between intimate partner abuse and mass violence was made horrifyingly clear, and will be one of the subjects of&nbsp;<a href=\"https:\/\/masscasualtycommission.ca\/\" target=\"_blank\" rel=\"noreferrer noopener\">the inquiry into the killings<\/a>&nbsp;now underway.&nbsp;<\/p>\n\n\n\n<p>The terror of violent misogyny, exemplified\u00a0by\u00a0but not limited to these\u00a0two\u00a0acts of mass murder, requires\u00a0urgent\u00a0government\u00a0action\u00a0to address gender-based violence today.\u00a0The\u00a0<a href=\"https:\/\/montreal.ctvnews.ca\/two-women-ages-60-and-28-dead-in-double-homicide-in-laurentians-police-1.5329813\" target=\"_blank\" rel=\"noreferrer noopener\">murders<\/a>\u00a0of\u00a0Myriam Dallaire and Sylvie Bisson\u00a0in Sainte-Sophie, Quebec, earlier this week\u00a0serve as yet another reminder of this terror. Women, girls, and\u00a0gender diverse people\u202fdeserve to be\u202ffree from violence, to feel secure, and to have access to supports that enable them to reach their full potential.\u202fFederal, provincial, and territorial\u00a0governments need to come together\u00a0to develop and implement a\u202f<a href=\"https:\/\/endvaw.ca\/wp-content\/uploads\/2020\/09\/Reissued-Call-NAP-on-VAW.GBV_.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">National Action Plan<\/a>\u202fon gender-based violence, which must be grounded in intersectional feminist principles and recognize\u202fthe diversity of identities and needs of the\u202fsurvivors.\u202fGovernments must also prioritize\u202fthe\u202fimplementation of\u202fthe\u202f<a href=\"https:\/\/www.mmiwg-ffada.ca\/final-report\/\" target=\"_blank\" rel=\"noreferrer noopener\">231 Calls for\u00a0Justice<\/a>\u00a0from the National Inquiry into Missing and Murdered Indigenous Women and Girls, which have thus far gone\u202funanswered.\u202f<\/p>\n","protected":false},"featured_media":0,"template":"","meta":{"_acf_changed":false},"categories":[],"tags":[434,457,474],"class_list":["post-18584","news","type-news","status-publish","hentry","tag-gender-based-violence","tag-online-hate","tag-public-statement"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
