{"id":19500,"date":"2021-07-06T09:17:55","date_gmt":"2021-07-06T13:17:55","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=news&#038;p=19500"},"modified":"2021-07-06T09:17:57","modified_gmt":"2021-07-06T13:17:57","slug":"r-v-kirkpatrick-leave-decision","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/r-v-kirkpatrick-leave-decision\/","title":{"rendered":"LEAF to tell Supreme Court that sex with a condom is different than sex without a condom"},"content":{"rendered":"\n<p><strong>July 6, 2021<\/strong> &#8211; When someone consents to sexual activity with a condom, that does not mean they also consent to sex without a condom, says the Women\u2019s Legal Education and Action Fund (LEAF).<\/p>\n\n\n\n<p>Last week, the Supreme Court of Canada determined that LEAF can make submissions to the Court as an intervener in <em>R. v. Kirkpatrick <\/em>when it is heard on November 3, 2021. This case deals with the boundaries of consent to sexual activity under Canadian criminal law. The complainant testified that she insisted the accused use a condom during sex. The first time he used one, but the second time he did not. This raises the question: if someone is asked to use a condom, but they do not comply, is the activity considered consensual? LEAF will submit to the Supreme Court that it is not.<\/p>\n\n\n\n<p>\u201cThe right to insist on condom use during sex is fundamental to the equality and autonomy of women and gender-diverse people,\u201d says Pam Hrick, LEAF\u2019s Executive Director &amp; General Counsel. \u201cThe Supreme Court\u2019s decision in this case will impact marginalized individuals \u2013 including Black, Indigenous, and trans women \u2013 who are disproportionately the victims of sexual violence, and often denied the equal protection of the criminal law.\u201d<\/p>\n\n\n\n<p>The <em>Criminal Code <\/em>defines consent as \u201cthe voluntary agreement of the complainant to engage in the sexual activity in question.\u201d LEAF will argue that including \u201csexual activity with a condom\u201d in the definition of \u201csexual activity in question\u201d promotes substantive equality for equity-seeking groups. Sexual activity with a condom and without a condom are separate acts that require separate consent.
