September 8, 2021 <\/strong>– We’ve put together a factsheet<\/a> to help break down the issues in LEAF’s upcoming intervention in R. v. Sullivan <\/em>and R. v. Chan<\/em>!<\/p>\n\n\n\n

These cases will examine the\u00a0defence\u00a0of\u00a0\u201cself-induced extreme intoxication\u201d\u00a0under Canadian criminal law.\u00a0The\u00a0Criminal Code\u00a0<\/em>says\u00a0that\u00a0where a person is\u00a0accused of\u00a0certain\u00a0violent\u00a0offences,\u00a0including sexual assault,\u00a0they are not allowed to use\u00a0their\u00a0own\u00a0extreme intoxication as a\u00a0defence.\u00a0Last year, the Court of Appeal for Ontario\u00a0held\u00a0that this rule violates\u00a0the\u00a0Charter<\/em>\u00a0rights of accused persons. The\u00a0Supreme\u00a0Court\u00a0will\u00a0soon\u00a0decide whether it agrees.\u00a0<\/p>\n\n\n\n

LEAF will\u00a0focus on the need to balance\u00a0Charter\u00a0<\/em>rights\u00a0in\u00a0deciding whether accused persons should have access to this\u00a0defence\u00a0\u2013 including women\u2019s equality rights and rights to security of the person, as well as the rights of the accused.\u00a0LEAF will also\u00a0examine the role of Parliament in enacting laws to hold people accountable, including for their actions while extremely intoxicated.\u00a0<\/p>\n\n\n\n

If the Supreme Court finds that\u00a0accused persons should have access to the\u00a0defence,\u00a0there is a danger that\u00a0sexual assault survivors will see this\u00a0as yet\u00a0another way the justice system has failed\u00a0them.\u00a0For this reason, it is particularly important that those\u00a0writing about and\u00a0commenting on this case\u00a0provide accurate information about the limited availability of the\u00a0defence, so that survivors who want to report\u00a0do not see this as a barrier to reporting.<\/p>\n\n\n\n
