October\u00a028, 2021<\/strong>\u00a0\u2013\u00a0If someone consented to sexual activity with a condom but their partner does not comply, is the activity consensual? LEAF will\u00a0submit to the Supreme Court that\u00a0it is not, when the Supreme Court\u00a0hears\u00a0submissions in\u00a0R. v. Kirkpatrick\u00a0<\/em>on November 3.<\/p>\n\n\n\n

\u201cSexual activity without a condom is materially different than sexual activity with a condom,\u201d says Rosel Kim, Staff Lawyer at LEAF. \u201cRequesting condom use\u00a0is an essential element of exercising your sexual autonomy.\u201d<\/p>\n\n\n\n

The\u202fCriminal Code\u202f<\/em>defines consent as \u201cthe voluntary agreement of the complainant to engage in the sexual activity in question.\u201d\u00a0LEAF will argue that including condom use\u00a0in the definition of \u201csexual activity in question\u201d promotes substantive equality for equity-seeking groups.\u00a0These groups\u00a0include\u00a0those experiencing intersecting marginalization and gendered power imbalances,\u00a0such as\u00a0women, girls, trans, and non-binary individuals.<\/p>\n\n\n\n

\u201cExcluding condom use from the definition of \u2018sexual activity in question\u2019 in the consent provision\u00a0of the\u00a0Criminal Code<\/em>\u00a0will exacerbate inequality for marginalized groups who are more likely to experience sexual violence, such as Black, Indigenous, and racialized women, girls, and gender-diverse people,\u201d says Kim.<\/p>\n\n\n\n
