{"id":22622,"date":"2022-06-30T15:43:09","date_gmt":"2022-06-30T19:43:09","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=news&#038;p=22622"},"modified":"2022-06-30T15:43:10","modified_gmt":"2022-06-30T19:43:10","slug":"supreme-court-upholds-important-protections-for-sexual-assault-survivors-in-criminal-trials","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/supreme-court-upholds-important-protections-for-sexual-assault-survivors-in-criminal-trials\/","title":{"rendered":"Supreme Court upholds important protections for sexual assault survivors in criminal trials"},"content":{"rendered":"\n<p><strong>June 30, 2022 <\/strong>\u2013 Today\u2019s Supreme Court decision upholds important protections for sexual assault survivors in criminal trials, says the Women\u2019s Legal Education and Action Fund (LEAF).&nbsp;&nbsp;<\/p>\n\n\n\n<p>In <a href=\"https:\/\/decisions.scc-csc.ca\/scc-csc\/scc-csc\/en\/item\/19428\/index.do\" target=\"_blank\" rel=\"noreferrer noopener\">its decision<\/a> in <a href=\"https:\/\/www.scc-csc.ca\/case-dossier\/info\/sum-som-eng.aspx?cas=39516\" target=\"_blank\" rel=\"noreferrer noopener\"><em>A.S. v. Her Majesty the Queen<\/em><\/a> and <em>R. v. J.J<\/em>., a majority of the Court upheld a legal framework put in place to protect the equality rights of complainants in sexual assault cases. In upholding the framework, the majority recognized that criminal trials \u201ccan be invasive, humiliating, and degrading for victims of sexual offences\u201d and that \u201c[m]ore needs to be done.\u201d The Court also provided more clarity on how the framework should be implemented.&nbsp;<\/p>\n\n\n\n<p>\u201cWe are pleased by today\u2019s decision, which will promote access to justice for complainants,\u201d says Pam Hrick, LEAF Executive Director &amp; General Counsel. \u201cThe Court clearly recognized and responded to the equality, privacy, and dignity of complainants while respecting the accused\u2019s right to full answer and defence.\u201d&nbsp;<\/p>\n\n\n\n<p>Sexual violence disproportionately affects women and girls. Black, Indigenous, trans, queer, and\/or disabled women face even higher rates of sexual violence. At the same time, less than 10% of sexual assault incidents are ever reported in Canada. When survivors do report, police dismiss one in five sexual assault reports as unfounded.&nbsp;<\/p>\n\n\n\n<p>\u201cCriminal trials often re-traumatize survivors\u201d, says Hrick. \u201cFor those survivors who choose to report, this decision upholds important protections for complainants and reaffirms the need to improve criminal justice responses to sexual assault.\u201d&nbsp;<\/p>\n\n\n\n<p>With today\u2019s decision, an accused person in possession of a complainant\u2019s private records (such as text messages, photographs, and medical records) cannot surprise the complainant with these records during a trial. Instead, the accused person must ask the judge to hold a separate hearing and decide whether to allow the records to be used in court. The judge will consider different factors in making the decision, including factors supporting the equality rights of complainants. Complainants have the right to participate in these hearings, and to have access to independent counsel to help them participate.&nbsp;&nbsp;<\/p>\n\n\n\n<p>While criminal justice responses must be improved, LEAF emphasizes the necessity of exploring alternative justice responses and working to end gender-based violence altogether.
