{"id":22676,"date":"2022-07-29T13:56:19","date_gmt":"2022-07-29T17:56:19","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=news&#038;p=22676"},"modified":"2022-07-29T13:57:18","modified_gmt":"2022-07-29T17:57:18","slug":"supreme-court-rules-that-where-consent-is-conditioned-on-condom-use-a-condom-must-be-worn","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/supreme-court-rules-that-where-consent-is-conditioned-on-condom-use-a-condom-must-be-worn\/","title":{"rendered":"Supreme Court rules that where consent is conditioned on condom use, a condom must be worn"},"content":{"rendered":"\n<p><strong>July 29, 2022 \u2013&nbsp; <\/strong>Today\u2019s Supreme Court of Canada decision makes clear the need to respect a person\u2019s decision to engage in sexual activity only with a condom, says the Women\u2019s Legal Education and Action Fund (LEAF).&nbsp;&nbsp;<\/p>\n\n\n\n<p>In its decision in <a href=\"https:\/\/decisions.scc-csc.ca\/scc-csc\/scc-csc\/en\/item\/19458\/index.do\" target=\"_blank\" rel=\"noreferrer noopener\"><em>R. v. Kirkpatrick<\/em><\/a>, a majority of the Supreme Court clarified that when a person consents to sex on the condition that their partner wear a condom, but the partner does not comply, the sexual activity in question is not consensual and constitutes sexual assault. LEAF intervened in this case to argue that this approach to consent in the context of condom use promotes substantive equality for equity-deserving groups, including women, girls, trans, and non-binary individuals.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cThis decision is an important statement that sexual partners must respect a decision to insist on condom use during sex,\u201d says Pam Hrick, LEAF\u2019s Executive Director &amp; General Counsel. \u201cThis is foundational to the right to sexual autonomy and equality.\u201d&nbsp;<\/p>\n\n\n\n<p>The majority of the Supreme Court recognized that sex with a condom is a \u201cfundamentally and qualitatively different physical act\u201d than sex without a condom. It made clear that when someone says \u201cno, not without a condom\u201d, Canada\u2019s consent law says this actually means \u201cno\u201d and cannot be reinterpreted as \u201cyes, without a condom.\u201d This means that when a survivor comes forward with a report of non-consensual condom refusal or removal, there is no need to additionally prove that the accused deceived the survivor.&nbsp;&nbsp;<\/p>\n\n\n\n<p>LEAF is also pleased that the majority recognized non-consensual condom refusal and removal as a form of sexual violence that disproportionately impacts women and gender-diverse people.
