{"id":23998,"date":"2024-05-13T13:56:53","date_gmt":"2024-05-13T17:56:53","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=news&#038;p=23998"},"modified":"2024-05-24T10:56:53","modified_gmt":"2024-05-24T14:56:53","slug":"leaf-to-intervene-in-new-brunswick-pronoun-policy-case","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/leaf-to-intervene-in-new-brunswick-pronoun-policy-case\/","title":{"rendered":"LEAF to intervene in New Brunswick pronoun policy case\u00a0"},"content":{"rendered":"\n<p><strong>May <\/strong><strong>13<\/strong><strong>, 2024 <\/strong>\u2013 Earlier this month, the Women\u2019s Legal Education and Action Fund (LEAF) was granted leave to intervene in a challenge to New Brunswick\u2019s discriminatory policy requiring parental consent to recognize the gender identity and chosen names of trans, non-binary, and gender-diverse students.&nbsp;<\/p>\n\n\n\n<p>In the summer of 2023, the New Brunswick government changed its policy on sexual orientation and gender identity. The policy, known as Policy 713, now requires parental consent before the chosen name or pronouns of a trans or non-binary student who is under 16 can be used by school personnel in the context of classroom, extracurricular, and co-curricular activities.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The Canadian Civil Liberties Association is challenging the policy before the Court of King\u2019s Bench of New Brunswick, arguing that the process leading to the changes to Policy 713 was flawed and procedurally unfair. They also argue that the policy infringes New Brunswick\u2019s <em>Education Act <\/em>and <em>Human Rights Act <\/em>as well as 2SLGBTQIA+ students\u2019 <em>Charter<\/em> rights to equality (section 15), liberty and security of the person (section 7), and freedom of expression (section 2(b)).&nbsp;<\/p>\n\n\n\n<p>LEAF was granted leave to make submissions in the case on the equality rights of trans, non-binary, and gender diverse youth.&nbsp;<\/p>\n\n\n\n<p>\u201cThe decision of some provinces to discriminate against trans, non-binary, and gender-diverse youth because it is politically popular must be fought with all legal tools available,\u201d said Pam Hrick, Executive Director and General Counsel of LEAF.&nbsp; \u201cAs a gender equality advocacy organization, LEAF is going to court in solidarity with trans, non-binary, and gender-diverse communities who are facing a new wave of institutionalized discrimination across the country.\u201d&nbsp;<\/p>\n\n\n\n<p>The new Policy 713 increases risks of harm for trans youth. The New Brunswick Association of School Psychologists <a href=\"https:\/\/static1.squarespace.com\/static\/60340d12be1db058065cdc10\/t\/64dba253048a5831dfebc552\/1692115539961\/On+Balance+Choose+Kindness+-+Advocate+Review+of+Policy+713.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">stated this clearly<\/a>: \u201c[m]isgendering transgender and gender diverse people increases risk of self harm, suicidal ideation, and other mental health concerns. As such, it is imperative that students\u2019 names and pronouns be respected and used in the school environment regardless of their age.\u201d New Brunswick doctors <a href=\"https:\/\/static1.squarespace.com\/static\/60340d12be1db058065cdc10\/t\/64dba253048a5831dfebc552\/1692115539961\/On+Balance+Choose+Kindness+-+Advocate+Review+of+Policy+713.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">have also stated<\/a> that the \u201closs of autonomy and control\u201d associated with being called the wrong name will increase student dropouts, victimization, and suicidality.&nbsp;<\/p>\n\n\n\n<p>\u201cWhile we know most families are loving and supportive of their children, we also know this isn\u2019t always the case,\u201d said Hrick. \u201cWhen the Court determines the legality of the policy, it needs to consider the best interests of the child and the prospect of family violence and other forms of abuse, such as bullying.\u201d&nbsp;<\/p>\n\n\n\n<p>A date for the hearing has not yet been set.&nbsp;<\/p>\n\n\n\n<p>LEAF is grateful to M\u00e9lanie Power, Morgan Camley, Kay Scorer, Kathryn Gullason, and Nicole Tzannidakis of Dentons Canada LLP, counsel to LEAF in this case.\u00a0LEAF is also grateful to Lauren Ogden (McInnes Cooper) local counsel for LEAF in this case.<\/p>\n\n\n\n<p>LEAF\u2019s interventions are guided, informed and supported by a case committee with expertise in the relevant issues.
