{"id":26684,"date":"2026-02-09T09:36:29","date_gmt":"2026-02-09T14:36:29","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=news&#038;p=26684"},"modified":"2026-02-09T09:36:30","modified_gmt":"2026-02-09T14:36:30","slug":"leaf-to-make-arguments-as-court-of-appeal-for-ontario-considers-constitutionality-of-encampment-evictions-for-the-first-time","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/leaf-to-make-arguments-as-court-of-appeal-for-ontario-considers-constitutionality-of-encampment-evictions-for-the-first-time\/","title":{"rendered":"LEAF to\u00a0make arguments as\u00a0Court of Appeal for Ontario\u00a0considers\u00a0constitutionality\u00a0of encampment evictions for the first time\u00a0"},"content":{"rendered":"\n<p><strong>Toronto,&nbsp;February 9, 2026&nbsp;<\/strong>\u2013&nbsp;This week,&nbsp;the Women&rsquo;s Legal Education and Action Fund (LEAF)&nbsp;will make arguments before the Court of Appeal for Ontario as it considers the constitutionality of&nbsp;encampment evictions in Hamilton, Ontario.&nbsp;<\/p>\n\n\n\n<p>In&nbsp;<em>Heegsma&nbsp;v. Hamilton (City)<\/em>, fourteen individuals who are or have been unhoused in Hamilton&nbsp;will&nbsp;argue that it is unconstitutional for&nbsp;the City&nbsp;to prohibit&nbsp;tents on public property.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The group argues that the&nbsp;encampment&nbsp;bans and evictions violate their rights under sections 7 and 15 of the&nbsp;<em>Charter<\/em>.&nbsp;Unable to access permanent housing or shelter beds, they&nbsp;have faced&nbsp;violence&nbsp;including sexual assault; increased health risks; and a lack of privacy.&nbsp;The trial judge dismissed their claim, but the Court of Appeal for Ontario will hear their appeal on February 10 and 11, 2026.&nbsp;<\/p>\n\n\n\n<p>LEAF\u2019s arguments&nbsp;emphasize the intersectional realities of homelessness for women and gender-diverse people.&nbsp;Systemic inequality&nbsp;means that&nbsp;women and gender-diverse&nbsp;people&nbsp;disproportionately&nbsp;earn less, have precarious housing, and experience intimate partner violence.&nbsp;They then face unique pathways to homelessness, with&nbsp;Indigenous,&nbsp;Black,&nbsp;racialized,&nbsp;and&nbsp;disabled&nbsp;women&nbsp;and gender-diverse&nbsp;people&nbsp;facing compounded impacts of homelessness as well.&nbsp;<\/p>\n\n\n\n<p>\u201cWe need affordable and accessible housing for all,\u201d says Ruth Goba, LEAF Executive Director. \u201cIn just this case, two Indigenous women had to leave their housing because of&nbsp;the threat of&nbsp;physical and sexual violence from their landlords.&nbsp;It is unacceptable&nbsp;for anyone to need to choose between enduring violence&nbsp;or becoming unhoused.\u201d&nbsp;<\/p>\n\n\n\n<p>While encampments cannot be a long-term solution to the housing crisis, municipal&nbsp;encampment bans and evictions&nbsp;are not the answer.&nbsp;Women and gender-diverse&nbsp;people have far fewer shelter options available to them than men, even though in Hamilton women make up&nbsp;approximately half&nbsp;of the unhoused population.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cThe Court needs to know that, for many unhoused women and gender-diverse people,&nbsp;staying at an encampment is&nbsp;the safest and most accessible&nbsp;shelter&nbsp;option&nbsp;available,\u201d&nbsp;says Ms. Goba. \u201cWhen cities displace women, trans and non-binary people from encampments, they may need to turn&nbsp;to&nbsp;unsafe shelter&nbsp;options,&nbsp;such as&nbsp;returning to an abusive relationship or&nbsp;sleeping&nbsp;unsheltered.\u201d&nbsp;<\/p>\n\n\n\n<p><em>Heegsma&nbsp;<\/em>is&nbsp;the first case on the constitutionality of sheltering restrictions and encampment evictions to reach the Court of Appeal for Ontario.
