UR Pride Centre for Sexuality and Gender Diversity<\/em>, a case&nbsp;that will determine&nbsp;if&nbsp;courts can&nbsp;decide&nbsp;whether&nbsp;Saskatchewan\u2019s pronoun law \u2013 and other discriminatory laws passed using the&nbsp;<a href=\"https:\/\/www.leaf.ca\/factsheet\/all-about-the-notwithstanding-clause\/\" target=\"_blank\" rel=\"noreferrer noopener\">notwithstanding clause<\/a>&nbsp;\u2013 violates&nbsp;fundamental&nbsp;rights&nbsp;guaranteed by the&nbsp;<em>Canadian Charter of Rights and Freedoms<\/em>.&nbsp;<\/p>\n\n\n\n<p>In 2023, Saskatchewan passed a law requiring&nbsp;parental consent for school&nbsp;staff&nbsp;to be&nbsp;permitted&nbsp;to refer to a trans&nbsp;or&nbsp;non-binary student under the age of 16 by their proper name and pronouns.&nbsp;When UR Pride Centre for Sexuality and Gender Diversity took the Saskatchewan government to court&nbsp;\u2013 arguing&nbsp;that the law violates&nbsp;trans&nbsp;and&nbsp;non-binary&nbsp;students\u2019&nbsp;rights to life, liberty, and security of the person, and also violates&nbsp;their equality rights \u2013 the&nbsp;government&nbsp;used&nbsp;<a href=\"https:\/\/www.cbc.ca\/news\/canada\/saskatchewan\/sask-parental-rights-law-1.7002088\" target=\"_blank\" rel=\"noreferrer noopener\">the notwithstanding clause<\/a>&nbsp;to&nbsp;allow the law to be in effect regardless of whether it violates those rights.&nbsp;<\/p>\n\n\n\n<p>A\u00a0law passed using the\u00a0notwithstanding\u00a0clause\u00a0cannot be\u00a0struck down\u00a0by courts,\u00a0whether or not\u00a0it violates our rights. But does\u00a0using the\u00a0notwithstanding\u00a0clause\u00a0also stop a court from\u00a0assessing\u00a0whether the\u00a0law violates <em>Charter\u00a0<\/em>rights\u00a0and declaring as much in a court ruling?\u00a0\u00a0<\/p>\n\n\n\n<p>The Supreme Court will&nbsp;soon be deciding this question, and LEAF will be there&nbsp;to ensure that&nbsp;if&nbsp;a government&nbsp;discriminates&nbsp;against&nbsp;trans&nbsp;and&nbsp;non-binary youth, it&nbsp;has to&nbsp;answer to its&nbsp;discrimination&nbsp;in&nbsp;open court.&nbsp;<\/p>\n\n\n\n<p>LEAF will&nbsp;argue&nbsp;that&nbsp;it is vitally important for courts to&nbsp;be able to&nbsp;declare&nbsp;when&nbsp;a law violates&nbsp;<em>Charter&nbsp;<\/em>rights.&nbsp;It is&nbsp;essential&nbsp;for&nbsp;our democratic system:&nbsp;when&nbsp;a government&nbsp;uses&nbsp;the&nbsp;notwithstanding&nbsp;clause \u2013 as in, when it&nbsp;decides that it&nbsp;doesn\u2019t&nbsp;have to respect&nbsp;our&nbsp;rights&nbsp;\u2013 our&nbsp;courts\u2019 hands are tied, and our&nbsp;only recourse is via the ballot box.&nbsp;In these cases, if courts&nbsp;can&nbsp;declare when&nbsp;a government is violating our rights,&nbsp;voters can be better informed&nbsp;when&nbsp;they go to the polls.&nbsp;&nbsp;<\/p>\n\n\n\n<p>A court declaration of rights violations&nbsp;is&nbsp;crucial&nbsp;for&nbsp;the equality of&nbsp;the trans&nbsp;and&nbsp;non-binary&nbsp;youth in Saskatchewan&nbsp;at the centre of this case.&nbsp;\u201cRight now,&nbsp;these&nbsp;youth are&nbsp;being called by the wrong names and pronouns unless and until parental consent is obtained,\u201d says&nbsp;Cee Strauss, Senior Staff Lawyer&nbsp;at LEAF.&nbsp;\u201cRepeatedly&nbsp;using the wrong name or pronouns when addressing someone, especially&nbsp;in&nbsp;front of&nbsp;their&nbsp;peers, is a profoundly distressing experience for that person that can cause lasting&nbsp;harm to their mental health.\u201d&nbsp;<\/p>\n\n\n\n<p>The effect of the&nbsp;law&nbsp;is also to&nbsp;out&nbsp;students to their families, even when&nbsp;they\u2019re&nbsp;not ready or&nbsp;when it may cause them harm.&nbsp;<\/p>\n\n\n\n<p>All of&nbsp;this harm is institutionally sanctioned.&nbsp;When&nbsp;trans and non-binary youth have their chosen names&nbsp;used&nbsp;at home and in school,&nbsp;<a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/29609917\/\" target=\"_blank\" rel=\"noreferrer noopener\">they experience&nbsp;lower rates of&nbsp;depression and suicidal ideation and attempts<\/a>.&nbsp;Instead,&nbsp;trans&nbsp;and&nbsp;non-binary youth&nbsp;in Saskatchewan&nbsp;are being told&nbsp;by their government&nbsp;that their&nbsp;lives do not matter.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cIf&nbsp;a&nbsp;government&nbsp;openly discriminates against a group of people,&nbsp;having a court&nbsp;publicly&nbsp;recognize&nbsp;that discrimination&nbsp;can help&nbsp;validate&nbsp;the&nbsp;harm&nbsp;experienced&nbsp;by&nbsp;that group,\u201d says&nbsp;Strauss.&nbsp;\u201cThis is especially important&nbsp;for&nbsp;trans&nbsp;and&nbsp;non-binary&nbsp;youth,&nbsp;who&nbsp;are&nbsp;often&nbsp;not believed to be credible narrators of their own identities and experiences of discrimination.
