As it stands now, the resolution fails to reflect the views of many governments and civil society organizations regarding the crucial linkages between sexual and reproductive health and rights issues and the resolution theme of \u201csexual violence.\u201d<\/p>\n\n\n\n<p>In the past, the Government of Canada has taken a leadership role in seeking to create advances to protect women from violence, as recent as April 11, 2013 when Canada pledged $5 million to G8 efforts targeting sexual violence in conflict zones.<\/p>\n\n\n\n<p>The approach to the new resolution has been regressive. It represents a serious attack on women\u2019s rights and the health and wellbeing of survivors of sexual violence. The Government of Canada has used its role as chair of the negotiations to block commitment to provide access to a comprehensive package of services that are essential to survivors of sexual violence. Numerous governments and civil society organizations insist that these services must explicitly include: access to essential sexual and reproductive health services including emergency contraception, safe abortion (including review of laws that restrict access to abortion in cases of pregnancy resulting from rape), post-exposure prophylaxis for HIV infection, and diagnosis and treatment for sexually transmitted infections. In addition to this, the Canadian government has blocked the inclusion of references to critical prevention strategies, including providing comprehensive sexuality education to adolescents, which challenge gender stereotypes and norms and promote gender equality, therefore contributing to eliminating all forms of gender-based violence, stigma and discrimination.<\/p>\n\n\n\n<p>Blocking references to the full realization of women\u2019s human rights, by refusing to secure the access of survivors of sexual violence to essential sexual and reproductive health services, constitutes not only a troubling departure from Canadian law but also legally-binding international treaties to which Canada is a party, including the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), International Covenant on Economic, Social and Cultural Rights (ICESCR), and the International Covenant on Civil and Political Rights (ICCPR). Moreover, this position alienates Canada\u2019s traditional allies, who continue to express grave concern regarding Canada\u2019s failure to recognize the linkages between sexual and reproductive health and rights and sexual violence.<\/p>\n\n\n\n<p>In addition to concerns about the content of the resolution, we are concerned about the tone of the negotiation process. Actions of the Government of Canada, which chairs negotiations of the annual HRC resolution on violence against women, have hampered the negotiation process. This has included circulating drafts of the resolution only a short time before negotiation meetings thereby hindering other governments\u2019 abilities to engage meaningfully in the negotiations, and not including numerous critical proposals pertaining to sexual and reproductive rights and health that were made during negotiations that had broad support from governments and received no opposition comments.<\/p>\n\n\n\n<p><strong>We call on the Canadian government to include (at a minimum) the following operational provisions in the text, which commit to:<\/strong><\/p>\n\n\n\n<p>1. Providing survivors of sexual violence with essential sexual and reproductive health services;<br>2. Providing comprehensive sexuality education to adolescents which would promote not just sexual and reproductive health and rights but also gender equality, and hence reduce gender-based violence; and<br>3. Reviewing abortion laws and regulations that restrict or deny access to safe abortion in cases of pregnancy resulting from rape.<\/p>\n\n\n\n<p><strong>Failing to include these references represents a significant roll back on international agreements, including the recent 57th Session on the Commission on the Status of Women (CSW), which will result in <span style=\"text-decoration: underline;\">serious consequences for women\u2019s rights at the UN, and at the national level, including for survivors of sexual violence<\/span>.<\/strong><\/p>\n\n\n\n<p>In line with the above recommendations, at a minimum, this resolution must reflect and not deliver less than what was agreed at this past CSW. Elle repr\u00e9sente une atteinte grave aux droits des femmes et \u00e0 la sant\u00e9 et au bien-\u00eatre des victimes de violences sexuelles. Le gouvernement du Canada a utilis\u00e9 son r\u00f4le en tant que pr\u00e9sident des n\u00e9gociations pour bloquer l\u2019engagement de fournir l\u2019acc\u00e8s \u00e0 un ensemble complet de services qui sont essentiels aux survivant-e-s de violences sexuelles. De nombreux gouvernements et organisations de la soci\u00e9t\u00e9 civile insistent sur le fait que ces services doivent inclure explicitement: l\u2019acc\u00e8s aux services essentiels de sant\u00e9 sexuelle et reproductive, y compris la contraception d\u2019urgence, l\u2019avortement sans risque (dont une r\u00e9vision&nbsp; des lois qui restreignent l\u2019acc\u00e8s \u00e0 l\u2019avortement en cas de grossesse r\u00e9sultant d\u2019un viol), la prophylaxie post-exposition en cas d\u2019infection au VIH, et le diagnostic et le traitement des infections sexuellement transmissibles. En plus de cela, le gouvernement canadien a emp\u00each\u00e9 l\u2019inclusion de r\u00e9f\u00e9rences \u00e0 des strat\u00e9gies essentielles de pr\u00e9vention, dont l\u2019apport d\u2019une \u00e9ducation sexuelle compl\u00e8te aux adolescent-e-s, afin de remettre en question les st\u00e9r\u00e9otypes et les normes entre les sexes et d\u2019encourager l\u2019\u00e9galit\u00e9 entre les sexes, contribuant ainsi \u00e0 l\u2019\u00e9limination de toutes les formes de violence fond\u00e9e sur le sexe, la stigmatisation et la discrimination.<\/p>\n\n\n\n<p>Le fait d\u2019emp\u00eacher les r\u00e9f\u00e9rences \u00e0 une actualisation compl\u00e8te des droits humains des femmes, et de refuser de garantir l\u2019acc\u00e8s des victimes de violences sexuelles aux services de sant\u00e9 sexuelle et reproductive essentiels, constitue non seulement une transgression inqui\u00e9tante de la loi canadienne, mais aussi des trait\u00e9s internationaux juridiquement contraignants dont le Canada est partie, notamment la Convention sur l\u2019\u00e9limination de toutes les formes de discrimination \u00e0 l\u2019\u00e9gard des femmes, le Pacte international relatif aux droits \u00e9conomiques, sociaux et culturels, et le Pacte international relatif aux droits civils et politiques. En outre, cette position ali\u00e8ne les alli\u00e9s traditionnels du Canada, qui continuent \u00e0 exprimer leur profonde pr\u00e9occupation concernant l\u2019\u00e9chec du Canada \u00e0 reconna\u00eetre les liens entre la sant\u00e9,&nbsp; les droits sexuels et reproductifs et la violence sexuelle.<\/p>\n\n\n\n<p>En plus de nos pr\u00e9occupations au sujet du contenu de la r\u00e9solution, nous sommes pr\u00e9occup\u00e9s par le ton du processus de n\u00e9gociation. Les actions du gouvernement du Canada, qui pr\u00e9side les n\u00e9gociations de la r\u00e9solution annuelle du CDH sur la violence contre les femmes, ont entrav\u00e9 ce processus. Le gouvernement a notamment attendu la derni\u00e8re minute avant les r\u00e9unions de n\u00e9gociation avant de faire circuler des libell\u00e9s de la r\u00e9solution, entravant ainsi la capacit\u00e9 des autres gouvernements \u00e0 s\u2019engager de fa\u00e7on constructive dans les n\u00e9gociations, et n\u2019y int\u00e9grant pas de nombreuses propositions importantes relatives \u00e0 la sant\u00e9 et aux droits sexuels et reproductifs qui avaient \u00e9t\u00e9 faites au cours des n\u00e9gociations, avaient recueilli un large soutien des gouvernements et n\u2019avaient re\u00e7u aucun commentaire d\u2019opposition.<\/p>\n\n\n\n<p><strong>Nous demandons au gouvernement canadien d\u2019inclure (au minimum) les dispositions op\u00e9rationnelles suivantes dans le texte, en s\u2019engageant \u00e0:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Fournir aux victimes de violences sexuelles des services essentiels de sant\u00e9 sexuelle et reproductive;<\/li><li>Offrir une \u00e9ducation compl\u00e8te \u00e0 la sexualit\u00e9 des adolescent-e-s qui ne se contente pas de favoriser la sant\u00e9 et les droits sexuels et reproductifs, mais priorise aussi l\u2019\u00e9galit\u00e9 des sexes, et donc une r\u00e9duction de la violence fond\u00e9e sur le sexe,<\/li><li>Examiner les lois et r\u00e8glements qui limitent ou interdisent l\u2019acc\u00e8s \u00e0 l\u2019avortement en cas de grossesse r\u00e9sultant d\u2019un viol.<\/li><\/ol>\n\n\n\n<p class=\"has-text-align-left\"><strong>Le d\u00e9faut d\u2019inclure ces r\u00e9f\u00e9rences repr\u00e9sente un recul significatif de nos engagements pris dans des accords internationaux, y compris lors de la r\u00e9cente 57\u00e8me session de la Commission de la condition de la femme, ce qui entra\u00eenera de <span style=\"text-decoration: underline;\">graves cons\u00e9quences pour les droits des femmes \u00e0 l\u2019ONU et au niveau national, y compris pour les victimes de violences sexuelles.<\/span><\/strong><\/p>\n\n\n\n<p>En accord avec les recommandations pr\u00e9cit\u00e9es, cette r\u00e9solution doit, au minimum, refl\u00e9ter ce qui avait \u00e9t\u00e9 convenu \u00e0 la pr\u00e9c\u00e9dente Commission de la condition de la femme et ne livrer rien de moins Nous esp\u00e9rons que vous tiendrez&nbsp; cette affaire pour importante en prenant des mesures imm\u00e9diates pour assurer au texte final la pleine int\u00e9gration de ce qui pr\u00e9c\u00e8de.<\/p>\n\n\n\n<p>Cordialement,<\/p>\n\n\n\n<p>(signataires ci-dessous)<\/p>\n\n\n\n<p>CC: l`Honorable John Baird, P.
