We are deeply troubled by the ongoing and intensifying attacks against LGBT, not least those led and encouraged by President Vladimir Putin and the Duma. These actions include, most recently, the unanimous adoption on June 29th of a federal law banning the distribution of \u201cpropaganda of non-traditional sexual relations.\u201d<\/p>\n\n\n\n<p>This law means LGBT people risk prosecution simply for exercising their freedom of expression and association, as does anyone who defends the human rights of LGBT people or even mentions the existence of LGBT people in an approving fashion. Attending an LGBT event could be illegal. Challenging the harassment or assault of LGBT students in a school or declaring that it\u2019s perfectly legitimate to be LGBT could amount to \u201cgay propaganda\u201d under the wording of the law.<\/p>\n\n\n\n<p>Individuals can be fined up to 100,000 rubles (about US$ 3000) for using the media or Internet to \u201cpromote non-traditional relations.\u201d Organizations can be fined up to 1 million roubles (US$ 30,000) and closed down for up to 90 days. The law authorizes police officers to arrest tourists and foreign nationals they suspect of being LGBT or \u201cpro-gay\u201d and detain them for up to 15 days before expelling them from the country. Russian officials have already threatened to arrest, and actually arrested, gay tourists.<\/p>\n\n\n\n<p>There have been other recent legislative and physical assaults on LGBT people in Russia. Moscow\u2019s city government has banned Pride parades for 100 years, which the European Court of Human Rights has declared violates the European Convention on Human Rights. The city of St. Petersburg has enacted a ban on \u201chomosexual propaganda.\u00a0\u00bb Russia has banned adoption of children by any parents from nations that grant equal marriage rights to same-sex couples.<\/p>\n\n\n\n<p>The latest \u201canti-propaganda\u201d law is part of a much broader, ongoing attack to shut down civil society, including a series of laws that violate freedoms of assembly, association, expression and information, not just for LGBT people but for a whole range of communities and human rights defenders. Homophobia is another weapon being deployed in a broader effort to stifle a free, open, democratic society. Targeting a group to be scapegoated is aimed at weakening any civil society opposition and maintaining control.<\/p>\n\n\n\n<p>Such legislative hate-mongering does indeed foment further abuses. Anti-LGBT violence is rampant and worsening in Russia. Earlier this summer, a violent mob attacked a small group of LGBT rights demonstrators in St. Petersburg. LGBT youth and adults are being assaulted and tortured by thugs who then broadcast video recordings of these attacks online. So far, Russian authorities have turned a blind eye to such hate crimes, even though some perpetrators are easily identifiable. In a recent incident, two attackers savagely beat a man, crushing his ribs, sodomizing him with beer bottles and attempting to burn him alive, after they learned of his sexual identity. They declared that it was their \u201cpatriotic duty to kill a gay man.\u201d<\/p>\n\n\n\n<p>Twenty years ago, at the 1993 World Conference on Human Rights, Russia joined with other countries in declaring that the protection and promotion of human rights \u201cis the first responsibility of Governments.\u201d Yet in this climate of state-sponsored hatred and violence, Russia will host the Olympic and Paralympic Winter Games in Sochi in February 2014. The Russian government\u2019s active persecution of LGBT people flies in the face of not just international human rights law but the ostensible spirit of the Olympic Games. The international community, those countries and organizations participating in the Games, and those corporations profiting from the Games, cannot stand idly by in the face of state-sponsored terror against millions of its own people who are lesbian, gay, bisexual or transgender and against their partners, families, friends and loved ones.<\/p>\n\n\n\n<p>Therefore, in solidarity with our LGBT brothers and sisters in Russia, we call upon the <strong>Government of Canada, the International and Canadian Olympic Committees, as well as corporate sponsors and media broadcasters of the Sochi Winter Olympics, to take action as follows<\/strong>:<\/p>\n\n\n\n<p>The <strong>Government of Canada<\/strong> should:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>continue to speak out publicly against Russia\u2019s anti-gay legislation and homophobic and transphobic violence being visited upon LGBT people in Russia, and continue to communicate its objections directly to Russian authorities at the highest levels;<\/li><li>add the sponsors of anti-LGBT legislation in Russia to the list of those banned from obtaining visas to enter Canada;<\/li><li>identify opportunities to proactively support LGBT rights advocates in Russia in defending basic human rights;<\/li><li>oppose the \u201ctraditional values\u201d resolution being advanced by Russia at the UN, which is a patent attempt to cloak bigotry and hate in the legitimacy of a Human Rights Council resolution; and<\/li><li>use this opportunity to publicly announce its commitment to ongoing support for the UN\u2019s recently- launched \u201cFree and Equal\u201d initiative for LGBT rights.<\/li><\/ul>\n\n\n\n<p>The<strong> International Olympic Committee<\/strong> (IOC) and <strong>International Paralympic Committee <\/strong>(IPC) should:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>host Pride House in Sochi during the 2014 Winter Olympics and Paralympics;<\/li><li>speak out during the opening and closing ceremonies of the Games against anti-LGBT violence and against discrimination based on sexual orientation and gender identity, including legislative discrimination such as Russia\u2019s; and<\/li><li>include explicit reference in their respective Charters to discrimination based on sexual orientation or gender identity as incompatible with the Olympic and Paralympic Movements, as is already done with grounds such as race, gender and religion. (We note and welcome that the Paralympic Movement has already included sexual orientation.)<\/li><\/ul>\n\n\n\n<p>The <strong>Canadian Olympic Committee<\/strong> (COC) and<strong> Canadian Paralympic Committee <\/strong>(CPC) have authority over Canada\u2019s representation at the Olympic and Paralympic Games. Nous sommes profond\u00e9ment pr\u00e9occup\u00e9s par les attaques persistantes et croissantes \u00e0 l\u2019endroit des personnes LGBT, en particulier celles dirig\u00e9es et encourag\u00e9es par le pr\u00e9sident Vladimir Poutine et la Douma. Ces actions incluent l\u2019adoption unanime, le 29 juin, d\u2019une loi f\u00e9d\u00e9rale interdisant la \u00abpropagande sur les relations sexuelles non traditionnelles\u00bb.<\/p>\n\n\n\n<p>Cette loi signifie que des personnes LGBT risquent d\u2019\u00eatre poursuivies pour avoir simplement exerc\u00e9 leur droit de libert\u00e9 d\u2019expression et d\u2019association, de m\u00eame que quiconque d\u00e9fend les droits humains des personnes LGBT ou mentionne leur existence de mani\u00e8re approbative. La participation \u00e0 un \u00e9v\u00e9nement LGBT pourrait \u00eatre ill\u00e9gale. Le fait de contester le harc\u00e8lement ou l\u2019agression d\u2019\u00e9tudiants LGBT dans une \u00e9cole ou de d\u00e9clarer qu\u2019il est parfaitement l\u00e9gitime d\u2019\u00eatre LGBT pourrait \u00eatre consid\u00e9r\u00e9 comme de la \u00abpropagande gaie\u00bb, en vertu du texte de loi.<\/p>\n\n\n\n<p>Les individus qui utilisent des m\u00e9dias ou Internet pour \u00abpromouvoir des relations non traditionnelles\u00bb sont passibles d\u2019amendes allant jusqu\u2019\u00e0 100000 roubles (environ 3000$US); les organismes pourraient devoir payer jusqu\u2019\u00e0 1 million de roubles (30000$US) et fermer leurs portes pendant jusqu\u2019\u00e0 90 jours. La loi autorise les policiers \u00e0 arr\u00eater des touristes ou des ressortissants \u00e9trangers qu\u2019ils soup\u00e7onnent d\u2019\u00eatre LGBT ou \u00abpro-gai\u00bb et \u00e0 les garder en d\u00e9tention jusqu\u2019\u00e0 15 jours avant de les expulser du pays. Les autorit\u00e9s russes ont d\u00e9j\u00e0 arr\u00eat\u00e9 des touristes gais.<\/p>\n\n\n\n<p>\u00c0 cela s\u2019ajoutent d\u2019autres moyens l\u00e9gislatifs et physiques \u00e0 l\u2019encontre des personnes LGBT en Russie. Le gouvernement de la ville de Moscou interdit les d\u00e9fil\u00e9s gais depuis 100 ans \u2014 ce que la Cour europ\u00e9enne des droits de l\u2019homme a d\u00e9clar\u00e9 comme \u00e9tant une violation de la Convention europ\u00e9enne des droits de l\u2019homme. La ville de Saint-P\u00e9tersbourg a \u00e9dict\u00e9 une interdiction de \u00abpropagande homosexuelle\u00bb. La Russie interdit l\u2019adoption d\u2019enfants par des parents venus de pays o\u00f9 des droits \u00e9gaux de mariage sont accord\u00e9s aux couples de m\u00eame sexe.<\/p>\n\n\n\n<p>La plus r\u00e9cente loi \u00abanti-propagande\u00bb s\u2019inscrit dans le cadre d\u2019une offensive continue et \u00e9largie contre la soci\u00e9t\u00e9 civile, qui inclut une s\u00e9rie de lois enfreignant les libert\u00e9s de r\u00e9union, d\u2019association, d\u2019expression et d\u2019information, non seulement pour les personnes LGBT mais aussi pour un vaste \u00e9ventail de communaut\u00e9s et de d\u00e9fenseurs des droits de la personne. L\u2019homophobie est une autre arme d\u00e9ploy\u00e9e dans un effort g\u00e9n\u00e9ralis\u00e9 pour \u00e9touffer une soci\u00e9t\u00e9 d\u00e9mocratique libre et ouverte. Des groupes sont cibl\u00e9s en tant que boucs \u00e9missaires, dans une tactique pour affaiblir l\u2019opposition de la soci\u00e9t\u00e9 civile et pour maintenir le contr\u00f4le.<\/p>\n\n\n\n<p>Une telle incitation \u00e0 la haine, dans la loi, contribue de fait \u00e0 perp\u00e9tuer les abus. La violence anti-LGBT est r\u00e9pandue et continue de s\u2019aggraver, en Russie. Plus t\u00f4t cet \u00e9t\u00e9, \u00e0 Saint-P\u00e9tersbourg, une foule violente s\u2019en est prise \u00e0 un petit groupe de manifestants pour les droits des LGBT. Des jeunes et des adultes LGBT sont agress\u00e9s et tortur\u00e9s par des voyous qui diffusent ensuite sur Internet des enregistrements vid\u00e9o de ces attaques. Jusqu\u2019ici, les autorit\u00e9s russes ont ferm\u00e9 les yeux sur ces crimes haineux, m\u00eame si certains de leurs auteurs sont facilement identifiables. Lors d\u2019un r\u00e9cent incident, deux agresseurs ont sauvagement battu un homme, lui fracturant des c\u00f4tes, le sodomisant avec des bouteilles de bi\u00e8re et tentant de le br\u00fbler vif, apr\u00e8s avoir appris son identit\u00e9 sexuelle. Ils ont affirm\u00e9 qu\u2019il \u00e9tait de leur \u00abdevoir patriotique de tuer un homme gai\u00bb.<\/p>\n\n\n\n<p>Il y a vingt ans, lors de la Conf\u00e9rence mondiale sur les droits de l\u2019homme de 1993, la Russie s\u2019est jointe \u00e0 d\u2019autres pays pour d\u00e9clarer que la protection et la promotion des droits de la personne \u00absont la premi\u00e8re responsabilit\u00e9 des gouvernements\u00bb. Pourtant, dans ce climat de haine et de violence appuy\u00e9 par l\u2019\u00c9tat, la Russie sera l\u2019h\u00f4te des Jeux olympiques et paralympiques d\u2019hiver de Sotchi, en f\u00e9vrier 2014. La pers\u00e9cution active des personnes LGBT par le gouvernement russe va \u00e0 l\u2019encontre du droit international des droits de la personne, mais aussi de l\u2019esprit qui est attribu\u00e9 aux Jeux olympiques. La communaut\u00e9 internationale, les pays et organismes participant aux Jeux ainsi que les entreprises qui tireront des profits de l\u2019\u00e9v\u00e9nement ne peuvent rester passifs devant cette terreur encens\u00e9e par l\u2019\u00c9tat \u00e0 l\u2019endroit de millions de personnes lesbiennes, gaies, bisexuelles ou transgenres et de leurs partenaires, familles, amis et proches.<\/p>\n\n\n\n<p>Par cons\u00e9quent, dans la solidarit\u00e9 avec nos fr\u00e8res et s\u0153urs LGBT de la Russie, <strong>nous exhortons le Gouvernement du Canada, les Comit\u00e9s olympiques international et canadien, les soci\u00e9t\u00e9s commanditaires et les diffuseurs des Jeux olympiques d\u2019hiver de Sotchi \u00e0 adopter les mesures suivantes:<\/strong><\/p>\n\n\n\n<p>Le <strong>Gouvernement du Canada<\/strong> devrait:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>continuer de d\u00e9noncer publiquement les lois russes anti-LGBT et la violence homophobe et transphobe rencontr\u00e9e par des personnes LGBT en Russie, et continuer de communiquer ses objections directement aux plus hauts \u00e9chelons des autorit\u00e9s russes;<\/li><li>ajouter les parrains de lois anti-LGBT en Russie \u00e0 la liste des personnes interdites de visa pour entrer au Canada;<\/li><li>identifier des occasions d\u2019appuyer de mani\u00e8re proactive les militants pour les droits des personnes LGBT en Russie, dans la d\u00e9fense des droits humains fondamentaux;<\/li><li>s\u2019opposer \u00e0 la r\u00e9solution sur les \u00abvaleurs traditionnelles\u00bb propos\u00e9e par la Russie \u00e0 l\u2019ONU \u2014 une tentative frappante de dissimuler bigoterie et haine sous le couvert l\u00e9gitime d\u2019une r\u00e9solution du Conseil des droits de l\u2019homme; et<\/li><li>annoncer publiquement, par l\u2019occasion, son engagement \u00e0 appuyer de mani\u00e8re continue la r\u00e9cente initiative \u00abLibres et \u00e9gaux\u00bb de l\u2019ONU pour les droits des personnes LGBT.<\/li><\/ul>\n\n\n\n<p>Le <strong>Comit\u00e9 international olympique <\/strong>(CIO) et le <strong>Comit\u00e9 international paralympique<\/strong> (CIP) devraient:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>h\u00e9berger une Maison de la Fiert\u00e9, \u00e0 Sotchi, pendant les Jeux olympiques et paralympiques d\u2019hiver de 2014;<\/li><li>d\u00e9noncer, lors des c\u00e9r\u00e9monies d\u2019ouverture et de cl\u00f4ture des Jeux, la violence contre les personnes LGBT et la discrimination fond\u00e9e sur l\u2019orientation sexuelle et l\u2019identit\u00e9 de genre, y compris la discrimination l\u00e9gislative comme en Russie; et<\/li><li>inclure des mentions explicites, dans leurs Chartes respectives, \u00e0 savoir que la discrimination fond\u00e9e sur l\u2019orientation sexuelle ou l\u2019identit\u00e9 de genre est incompatible avec les mouvements olympiques et paralympiques, comme ils le font d\u00e9j\u00e0 pour des motifs comme la race, le sexe et la religion. (Nous constatons que le mouvement paralympique a d\u00e9j\u00e0 inclus l\u2019orientation sexuelle et le f\u00e9licitons pour cette initiative.)<\/li><\/ul>\n\n\n\n<p>Le <strong>Comit\u00e9 olympique canadien<\/strong> (COC) et le <strong>Comit\u00e9 paralympique canadien (CPC) <\/strong>ont autorit\u00e9 sur la repr\u00e9sentation du Canada aux Jeux olympiques et paralympiques. Le leadership et les d\u00e9l\u00e9gations d\u2019athl\u00e8tes du COC et du CPC devraient:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>appuyer sans r\u00e9serve tout athl\u00e8te, de mani\u00e8re publique et priv\u00e9e, qu\u2019il s\u2019identifie comme \u00e9tant LGBT ou non, qui choisit de profiter de sa pr\u00e9sence aux Jeux (p. ex., au moment de recevoir une m\u00e9daille) pour afficher son appui aux personnes LGBT;<\/li><li>publier une d\u00e9claration condamnant les lois homophobes et la violence anti-LGBT en Russie;<\/li><li>participer de mani\u00e8re visible en tant que d\u00e9l\u00e9gation canadienne aux activit\u00e9s de la Fiert\u00e9 des Jeux d\u2019hiver de Sotchi, organis\u00e9es par des activistes russes pour les droits LGBT;<\/li><li>offrir au CIO et au CIP de collaborer \u00e0 h\u00e9berger la Maison de la Fiert\u00e9, lors des Jeux; et<\/li><li>utiliser les c\u00e9r\u00e9monies d\u2019ouverture et de cl\u00f4ture des Jeux pour appuyer de mani\u00e8re visible les droits humains des personnes LGBT, en tant que d\u00e9l\u00e9gation de pays.<\/li><\/ul>\n\n\n\n<p>Les<strong> soci\u00e9t\u00e9s commanditaires<\/strong> des Jeux de Sotchi, y compris les dix principaux commanditaires susmentionn\u00e9s, devraient:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>affirmer publiquement leur opposition aux lois homophobes russes et \u00e0 la violence anti-LGBT en Russie;<\/li><li>retirer aux Jeux leur commandite, \u00e0 moins que le gouvernement russe abolisse la \u00abloi anti-propagande\u00bb et garantisse les libert\u00e9s d\u2019expression, d\u2019association, de r\u00e9union et d\u2019information, y compris pour les personnes LGBT;
