{"id":4978,"date":"2013-10-18T10:04:23","date_gmt":"2013-10-18T14:04:23","guid":{"rendered":"https:\/\/www.leaf.ca\/?p=4978"},"modified":"2020-10-25T19:24:23","modified_gmt":"2020-10-25T23:24:23","slug":"the-quebec-charter-of-values-detracts-from-the-fight-for-womens-equality","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/the-quebec-charter-of-values-detracts-from-the-fight-for-womens-equality\/","title":{"rendered":"The Qu\u00e9bec Charter of Values Detracts from the Fight for Women\u2019s Equality"},"content":{"rendered":"\n<!--more-->\n\n\n\n<p>The Women&rsquo;s Legal Education and Action Fund (LEAF) wishes to voice its concerns regarding the Qu\u00e9bec government\u2019s proposed Qu\u00e9bec Charter of Values.<\/p>\n\n\n\n<p>There are five main components to the proposed Charter of Values:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Amend the Qu\u00e9bec Charter of Human Rights and Freedoms by entrenching state neutrality and secularism for public institutions;<\/li><li>Establish a duty of neutrality and reserve for all state personnel;<\/li><li>Limit the wearing of conspicuous religious symbols;<\/li><li>Make it mandatory to have one\u2019s face uncovered when providing or receiving a state service;<\/li><li>Establish an implementation policy for state organizations.<\/li><\/ol>\n\n\n\n<p>LEAF is committed to challenging all forms of discrimination against women through legal action, public education, and law reform under the <em>Canadian Charter of Rights and Freedoms<\/em>. LEAF believes that the proposed Qu\u00e9bec Charter of Values is divisive, unconstitutional, and counterproductive to achieving women\u2019s equality.<\/p>\n\n\n\n<p>The Qu\u00e9bec government states that: \u201cWe will be best served by a state that treats everyone the same.\u201d This statement is a throwback to the pre-<em>Charter <\/em>era when it was acceptable to discriminate on the basis of pregnancy, as long as all pregnant women were treated the same. This is precisely the kind of sentiment that women sought to address when we fought to gain the nuanced wording of section 15, the equality rights section, in the <em>Charter<\/em>. As LEAF has argued countless times, equality does not emanate from ostensibly treating everyone the same. Unless people are on the same footing to begin with, imposing a general rule that is on its face neutral, but divorced from all context, can often exacerbate inequality.<\/p>\n\n\n\n<p>The proposed Qu\u00e9bec Charter will not produce equality; it will only deepen inequality. The Qu\u00e9bec Charter will produce a fractured and oppressive public realm, where predominantly racialized women will be isolated and effectively punished for retaining adherence to their religious faiths and cultures. Indeed, L\u2019R des Centres de Femmes du Qu\u00e9bec, a coalition of Qu\u00e9bec women\u2019s centres, reports that there has been an increase in verbal and physical attacks against Muslim women across the province since the Charter of Values was proposed.<\/p>\n\n\n\n<p>Women identify ourselves not just by our sex, but by our race, religion, ancestry, and many other characteristics, including being a Francophone living in Quebec. We cannot be equal if only one aspect of our identity is considered apart from others intrinsic to our personhood.<\/p>\n\n\n\n<p>Particularly troubling are the following aspects of the proposed Charter of Values:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The ban on public sector employees from wearing \u00ab\u00a0ostentatious\u00a0\u00bb religious symbols while on the job will have a disproportionate impact on women, given that women form a large majority of employees in Qu\u00e9bec\u2019s public sector. Additional aspects create unfairness, such as the fact that while a Muslim man would not necessarily be required to choose between his employment and his religion, a hijab-wearing Muslim woman would be required to do so, thus jeopardizing her economic independence.<\/li><li>While the government\u2019s proposal would allow five-year opt-outs from the ban for certain organizations, daycare workers or elementary school teachers would not be covered by the opt-out.&nbsp; Of course, these two professions are predominantly staffed by women.<\/li><li>The proposal contains a requirement that those receiving or providing government services uncover their faces. Even if we were to suppose that some women do not wear a religious symbol by choice, would it not be better to assure their participation in public life and access to public services, rather than to decrease their exposure to the public sphere? Surely it would be better to facilitate women\u2019s engagement with those who hold different beliefs rather than banishing marginalized women from accessing public services. We should be engaging with women rather than imposing isolation upon them.<\/li><\/ul>\n\n\n\n<p>LEAF suggests that if the government really wants to address inequality between men and women, it should do the hard work of tackling the structural barriers to women\u2019s equality, such as those related to housing, employment, child and elder care, violence, health, poverty and discrimination on the basis of marital status. For example, the government could launch a campaign to address the persistent wage gap between men and women in its public service, a gap which is compounded for racialized women, including Francophone racialized women.<\/p>\n\n\n\n<p>To focus on what a woman wears in the name of equality is a perverse retrenchment of myths against which we have fought for a very long time. We need to engage with the issues that really matter in order to achieve equality, rather than seeking to divide us along lines that will only serve to intensify inequality. The proposal runs counter to a Canada and a Qu\u00e9bec that cherish and celebrate a diverse society. LEAF encourages the Qu\u00e9bec government to withdraw their proposed Charter of Values. We ask the government to focus instead on ameliorating the existing significant and real barriers that impede us from obtaining substantive equality for all women.<\/p>\n\n\n\n<p>You can review the proposed Qu\u00e9bec Charter <a href=\"http:\/\/www.nosvaleurs.gouv.qc.ca\/medias\/pdf\/communique_10septembre.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/p>\n\n\n\n<p><em>French Version<\/em><\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>La Charte des valeurs qu\u00e9b\u00e9coises nuit \u00e0 la lutte pour l\u2019\u00e9galit\u00e9 des femmes<\/strong><\/p>\n\n\n\n<p>Le Fonds d\u2019action et d\u2019\u00e9ducation juridiques pour les femmes (FAEJ) tient \u00e0 exprimer ses inqui\u00e9tudes au sujet de la Charte des valeurs qu\u00e9b\u00e9coises telle que propos\u00e9e par le gouvernement du Qu\u00e9bec.<\/p>\n\n\n\n<p>Le projet de Charte des valeurs contient cinq \u00e9l\u00e9ments principaux :<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Modification de la Charte qu\u00e9b\u00e9coise des droits et libert\u00e9s de la personne en y ench\u00e2ssant la neutralit\u00e9 de l\u2019\u00c9tat et la la\u00efcit\u00e9 des institutions publiques.<\/li><li>\u00c9tablissement d\u2019un devoir de neutralit\u00e9 et de r\u00e9serve pour l\u2019ensemble du personnel de l\u2019\u00c9tat.<\/li><li>Limitation du port de signes religieux ostentatoires.<\/li><li>L\u2019obligation de d\u00e9couvrir son visage au moment de fournir ou de recevoir un service de l\u2019\u00c9tat.<\/li><li>\u00c9tablissement d\u2019une politique de mise en \u0153uvre pour les organismes d\u2019\u00c9tat.<\/li><\/ol>\n\n\n\n<p>Le FAEJ est d\u00e9termin\u00e9 \u00e0 d\u00e9fier toutes formes de discrimination contre les femmes par l\u2019entremise d\u2019action en justice, de sensibilisation du public et de r\u00e9forme de la loi en vertu de la <em>Charte canadienne des droits et libert\u00e9s<\/em>. Le FAEJ estime que le projet de Charte des valeurs qu\u00e9b\u00e9coises est source de discorde, inconstitutionnel et contre-productif \u00e0 la r\u00e9alisation de l\u2019\u00e9galit\u00e9 des femmes.<\/p>\n\n\n\n<p>Le gouvernement du Qu\u00e9bec a d\u00e9clar\u00e9 que : \u00ab Nous serons mieux servis par un \u00c9tat qui traite tout le monde sur un pied d\u2019\u00e9galit\u00e9. \u00bb (trad.) Cette d\u00e9claration est un retour \u00e0 l\u2019\u00e8re pr\u00e9-<em>Charte <\/em>lorsqu\u2019il \u00e9tait acceptable de discriminer sur la base de la grossesse, tant et aussi longtemps que toutes les femmes enceintes \u00e9taient trait\u00e9es de la m\u00eame fa\u00e7on. C\u2019est pr\u00e9cis\u00e9ment le genre de sentiment que les femmes se sont efforc\u00e9es de traiter lorsqu\u2019elles se sont battues pour obtenir la formulation nuanc\u00e9e de l\u2019article 15 de la <em>Charte<\/em>, soit la section sur les droits \u00e0 l\u2019\u00e9galit\u00e9. Comme le FAEJ l\u2019a argu\u00e9 d\u2019innombrables fois, l\u2019\u00e9galit\u00e9 n\u2019\u00e9mane pas d\u2019apparemment traiter tout le monde de la m\u00eame fa\u00e7on. \u00c0 moins que les gens ne soient sur le m\u00eame pied d\u2019\u00e9galit\u00e9 au d\u00e9part, imposer une r\u00e8gle g\u00e9n\u00e9rale qui est neutre \u00e0 premi\u00e8re vue, mais dissoci\u00e9e de tout contexte, peut souvent exacerber les in\u00e9galit\u00e9s.<\/p>\n\n\n\n<p>Le projet de Charte qu\u00e9b\u00e9coise ne se traduira pas par l\u2019\u00e9galit\u00e9. Il ne fera qu\u2019aggraver les in\u00e9galit\u00e9s. La Charte qu\u00e9b\u00e9coise produira un environnement public fractur\u00e9 et oppressant, o\u00f9 les femmes majoritairement racialis\u00e9es seront isol\u00e9es et effectivement punies pour vouloir maintenir leurs croyances et leurs cultures religieuses. En effet, L\u2019R des Centres de Femmes du Qu\u00e9bec, une coalition des centres de femmes du Qu\u00e9bec, a remarqu\u00e9 une augmentation des attaques verbales et physiques contre les femmes musulmanes \u00e0 travers la province depuis que la Charte des valeurs a \u00e9t\u00e9 propos\u00e9e.<\/p>\n\n\n\n<p>En tant que femmes, nous nous identifions non seulement par notre sexe, mais par notre race, notre religion, notre ascendance et de nombreuses autres caract\u00e9ristiques, y compris \u00eatre une francophone vivant au Qu\u00e9bec. Nous ne pouvons pas \u00eatre \u00e9gales si un seul aspect de notre identit\u00e9 est consid\u00e9r\u00e9 \u00e0 part des autres aspects intrins\u00e8ques de notre individualit\u00e9.<\/p>\n\n\n\n<p>Les aspects suivants du projet de Charte des valeurs sont particuli\u00e8rement inqui\u00e9tants :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>L\u2019interdiction de porter des signes religieux \u00ab ostentatoires \u00bb pendant le travail visant les employ\u00e9(e)s du secteur public aura un impact disproportionn\u00e9 sur les femmes, \u00e9tant donn\u00e9 qu\u2019elles constituent la grande majorit\u00e9 des employ\u00e9(e)s du secteur public du Qu\u00e9bec. D\u2019autres aspects cr\u00e9ent de l\u2019injustice. Par exemple, un homme musulman ne serait pas forc\u00e9ment oblig\u00e9 de choisir entre son emploi et sa religion, tandis qu\u2019une femme musulmane portant le hijab devrait le faire, mettant ainsi en p\u00e9ril son ind\u00e9pendance \u00e9conomique.<\/li><li>Bien que la proposition du gouvernement pr\u00e9voie une possibilit\u00e9 d\u2019exemption de l\u2019interdiction de cinq ans pour certaines organisations, les \u00e9ducateurs et \u00e9ducatrices en garderie et les enseignant(e)s de l\u2019\u00e9cole \u00e9l\u00e9mentaire ne seraient pas exempt\u00e9(e)s. Bien s\u00fbr, ces deux professions sont principalement occup\u00e9es par des femmes.<\/li><li>La proposition contient une exigence \u00e0 l\u2019effet que ceux et celles qui re\u00e7oivent ou dispensent des services gouvernementaux d\u00e9couvrent leurs visages. M\u00eame si nous devions supposer que certaines femmes ne portent pas un symbole religieux par choix, ne vaudrait-il pas mieux assurer leur participation \u00e0 la vie publique et l\u2019acc\u00e8s aux services publics, plut\u00f4t que de r\u00e9duire leur exposition \u00e0 la sph\u00e8re publique? Assur\u00e9ment, il vaudrait mieux faciliter l\u2019engagement des femmes avec ceux et celles qui ont des croyances diff\u00e9rentes plut\u00f4t que d\u2019interdire aux femmes marginalis\u00e9es l\u2019acc\u00e8s aux services publics. Nous devrions \u00eatre aux c\u00f4t\u00e9s de ces femmes plut\u00f4t que de leur imposer l\u2019isolement.<\/li><\/ul>\n\n\n\n<p>Le FAEJ sugg\u00e8re que si le gouvernement veut vraiment lutter contre l\u2019in\u00e9galit\u00e9 entre les hommes et les femmes, il devrait faire le travail difficile qui consiste \u00e0 s\u2019attaquer aux obstacles structurels \u00e0 l\u2019\u00e9galit\u00e9 des femmes tels que ceux li\u00e9s au logement, \u00e0 l\u2019emploi, aux soins des enfants et des a\u00een\u00e9(e)s, \u00e0 la violence, \u00e0 la sant\u00e9, \u00e0 la pauvret\u00e9 et \u00e0 la discrimination fond\u00e9e sur l\u2019\u00e9tat matrimonial. Par exemple, le gouvernement pourrait lancer une campagne pour r\u00e9duire l\u2019\u00e9cart salarial persistant entre les hommes et les femmes dans sa fonction publique, un \u00e9cart qui s\u2019accro\u00eet pour les femmes racialis\u00e9es, y compris les femmes racialis\u00e9es francophones.<\/p>\n\n\n\n<p>Se concentrer sur ce qu\u2019une femme porte au nom de l\u2019\u00e9galit\u00e9 est un retranchement pervers de mythes contre lesquels nous nous sommes battu(e)s pendant tr\u00e8s longtemps. Nous devons nous engager envers les enjeux qui comptent vraiment pour parvenir \u00e0 l\u2019\u00e9galit\u00e9, plut\u00f4t que de chercher \u00e0 nous diviser selon des lignes qui ne serviront qu\u2019\u00e0 intensifier les in\u00e9galit\u00e9s. La proposition va \u00e0 l\u2019encontre d\u2019un Canada et d\u2019un Qu\u00e9bec qui ch\u00e9rissent et c\u00e9l\u00e8brent une soci\u00e9t\u00e9 diversifi\u00e9e. Le FAEJ encourage le gouvernement du Qu\u00e9bec \u00e0 retirer son projet de Charte des valeurs.
