We write today to urge you to advocate for the importance of consulting national women\u2019s organizations in any constitutional amendment and\/or Senate reform process. In addition, we write to urge you to ensure that the persistent under-representation of women in our Parliament will finally be ameliorated.<\/p>\n\n\n\n<p>For changes to our most fundamental institutions to be legitimate in this post-patriation period, Canadians must have a genuine opportunity to comment on them. In particular, any Senate reform process must be developed after transparent, open and accountable consultations with Canadian women in all their diversity. Ideally, such consultations would include hearings in every province and territory of Canada and should be accessible and sufficiently resourced to hear from all interested women\u2019s organizations.<\/p>\n\n\n\n<p>As rights-holders under the Constitution, women clearly have an interest in the interpretations and application of the Constitution. (1) We expect governments to explicitly consider and address how changes to our parliamentary democracy meet their obligations to ensure that the principles of equality enshrined in the <em>Canadian Charter of Rights and Freedoms<\/em> are applied to any proposed constitutional amendment or reform of governmental structures.<\/p>\n\n\n\n<p>The outcome of this<em> Reference<\/em> will affect the manner in which Senators are chosen in the future. Any new selection and\/or election processes must address the historic underrepresentation of women, minorities and Aboriginal peoples in Parliament. Over almost a century from women\u2019s first right to hold office, and almost half a century from the Royal Commission on the Status of Women, women do not yet even approach gender parity by population, let alone attaining, as a matter of course, the level of participation historically accorded to men. (2)<\/p>\n\n\n\n<p>The undersigned do not take a position with respect to the division of powers aspects of the Reference, nor do we take a position on the preferred route to reform of the Senate.&nbsp; We rather urge that all governments ensure that whatever process is undertaken, the mistakes of past constitutional amendment processes will not be repeated.&nbsp; Any such process must take into account the established principles of constitutional law.&nbsp; Women in Canada and other<em> Charter<\/em> rights-holders have a right to be included in any Senate reform process and any Senate reform process must promote substantive equality for women and minority groups.<\/p>\n\n\n\n<p>We do not see the <em>Reference<\/em> as the end point before Senate reform \u2013 we see it as the beginning point.&nbsp; We call upon all First Ministers to ensure that we have the opportunity to have our views heard and addressed in considering any changes to our democratic arrangements.<\/p>\n\n\n\n<p>Signed by:<br>Women\u2019s Legal Education and Action Fund (LEAF)<br>Canadian Association of Elizabeth Fry Societies (CAEFS)<br>Canadian Federation of University Women<br>Equal Voice Toronto<br>Metropolitan Action Committee on Violence Against Women and Children (METRAC)<br>National Association of Women and the Law (NAWL)<br>The Canadian Council of Muslim Women<br>The National Council of Women of Canada<br>West Coast Legal Education and Action Fund (West Coast LEAF)<br>YWCA Canada<\/p>\n\n\n\n<p>1. Information from the Library of Parliament confirms that, overall since the Persons Case decision in 1929, 92 women have been appointed to the Senate, compared to 841 men.&nbsp; Women currently account for 38 of 105 Senators, or 36.3%.&nbsp; Women have never reached parity in the House of Commons (or indeed in any provincial legislature).&nbsp; Women currently account for 76 of 308 members of Parliament, or 24.7% as of April 1, 2013. Le <em>Renvoi<\/em> est le premier du genre depuis le rapatriement de notre Constitution \u00e0 examiner comment, entre gouvernements, apporter des modifications \u00e0 notre syst\u00e8me d\u00e9mocratique repr\u00e9sentatif. Nous vous \u00e9crivons aujourd\u2019hui pour vous inciter \u00e0 plaider en faveur de l\u2019importance qu\u2019il y a \u00e0 consulter les organisations de femmes avant de proc\u00e9der \u00e0 tout amendement constitutionnel et\/ou processus de r\u00e9forme du S\u00e9nat. En outre, nous vous exhortons \u00e0 enfin adresser la sous-repr\u00e9sentation persistante des femmes au Parlement.<\/p>\n\n\n\n<p>Pour que les modifications devant \u00eatre apport\u00e9es \u00e0 nos institutions les plus fondamentales en cette p\u00e9riode d\u2019apr\u00e8s rapatriement soient l\u00e9gitimes, les Canadien(ne)s doivent \u00eatre v\u00e9ritablement en mesure de les commenter. En particulier, tout processus de r\u00e9forme du S\u00e9nat doit \u00eatre \u00e9labor\u00e9 apr\u00e8s la tenue de consultations transparentes, ouvertes et responsables aupr\u00e8s des femmes canadiennes, dans toute leur diversit\u00e9. Id\u00e9alement, ces dites consultations comprendraient la tenue d\u2019audiences dans chaque province et territoire du Canada. Elles devraient \u00eatre accessibles et dot\u00e9es des ressources n\u00e9cessaires pour entendre toutes les organisations de femmes int\u00e9ress\u00e9es.<\/p>\n\n\n\n<p>Comme titulaires de droits en vertu de la Constitution, il va de soi que les femmes ont un int\u00e9r\u00eat dans l\u2019interpr\u00e9tation et la mise \u00e0 ex\u00e9cution de la Constitution. (1) Nous attendons des gouvernements qu\u2019ils consid\u00e8rent et traitent explicitement la fa\u00e7on dont les modifications \u00e0 notre d\u00e9mocratie parlementaire respectent leurs obligations de veiller \u00e0 ce que les principes d\u2019\u00e9galit\u00e9 inscrits dans la <em>Charte canadienne des droits et libert\u00e9s<\/em> sont appliqu\u00e9s \u00e0 toute proposition d\u2019amendement constitutionnel ou \u00e0 toute r\u00e9forme des structures gouvernementales.<\/p>\n\n\n\n<p>Le r\u00e9sultat de ce Renvoi aura une incidence sur la fa\u00e7on dont les s\u00e9nateurs et s\u00e9natrices seront choisi(e)s plus tard. Tout nouveau processus de s\u00e9lection et\/ou \u00e9lectoral doit traiter de la sous-repr\u00e9sentation historique des femmes, des minorit\u00e9s et des peuples autochtones au Parlement. Alors que pr\u00e8s d\u2019un si\u00e8cle s\u2019est \u00e9coul\u00e9 depuis que les femmes ont obtenu pour la premi\u00e8re fois le droit d\u2019occuper un poste \u00e9lectif et presqu\u2019un demi-si\u00e8cle depuis la tenue de la Commission royale sur la condition de la femme, les femmes ne s\u2019approchent m\u00eame pas de la parit\u00e9 entre les sexes par rapport \u00e0 la population. Elles atteignent encore moins d\u2019office le niveau de participation dont les hommes se pr\u00e9valent. (2)<\/p>\n\n\n\n<p>Les soussign\u00e9es ne prennent pas position en ce qui concerne la r\u00e9partition des aspects de pouvoir du Renvoi, pas plus que nous ne prenons position sur la m\u00e9thode pr\u00e9f\u00e9r\u00e9e au moment de proc\u00e9der \u00e0 la r\u00e9forme du S\u00e9nat. Nous exhortons plut\u00f4t tous les gouvernements \u00e0 veiller \u00e0 ce que tout processus qui sera mis en place ne r\u00e9p\u00e8te pas les erreurs commises par les processus ant\u00e9rieurs lors d\u2019amendements constitutionnels. Un tel processus doit tenir compte des principes de droit constitutionnel \u00e9tablis. Les femmes au Canada et les autres titulaires de droits en vertu de la Charte ont le droit d\u2019\u00eatre inclus(es) dans tout processus de r\u00e9forme du S\u00e9nat. Et, tout processus de r\u00e9forme du S\u00e9nat doit promouvoir l\u2019\u00e9galit\u00e9 r\u00e9elle des femmes et des groupes minoritaires.<\/p>\n\n\n\n<p>Pour nous, le <em>Renvoi<\/em> n\u2019est pas le point final avant la r\u00e9forme du S\u00e9nat. Nous le consid\u00e9rons comme le point de d\u00e9part.
