D.A.I. at SCC<\/strong><\/p>\n\n\n\n<p>&nbsp;<b>May 13, 2011, Toronto<\/b> &#8211; On Tuesday May 17, 2011, LEAF and the DisAbled Women&rsquo;s Network Canada (DAWN-RAFH Canada), will intervene in the Supreme Court of Canada case of <i>R. v. D.A.I.<\/i><\/p>\n\n\n\n<p>\u00ab\u00a0At stake in this appeal is whether women with mental disabilities, who are among the most vulnerable women in our society, have access to justice when we are sexually abused\u00a0\u00bb says DAWN-RAFH Canada President Carmela Hutchison.<\/p>\n\n\n\n<p>The case involves an intellectually disabled woman (K.B.) who reported to a teacher that her step-father played \u00ab\u00a0games\u00a0\u00bb with her, which included touching her genitals and breasts.&nbsp;&nbsp; The evidence also revealed that the accused had a photograph of the complainant bare-breasted, stored in a trunk along with another pornographic photograph.&nbsp; The accused alleges that the photograph was taken innocently.<\/p>\n\n\n\n<p>K.B. made a statement to the police and testified at the preliminary inquiry.&nbsp; At trial, her competence to testify was successfully challenged.&nbsp; The Court held that K.B. was unable to adequately explain the meaning of abstract concepts like \u00ab\u00a0truth\u00a0\u00bb, \u00ab\u00a0lie\u00a0\u00bb and \u00ab\u00a0promise\u00a0\u00bb.&nbsp;&nbsp; For example, she was asked \u00ab\u00a0what do you think about the truth\u00a0\u00bb, \u00ab\u00a0What&rsquo;s a promise\u00a0\u00bb and \u00ab\u00a0If you tell big lies will you go to jail\u00a0\u00bb.&nbsp; K.B.&rsquo;s evidence was excluded.&nbsp; The trial proceeded without her evidence.&nbsp;The accused was acquitted.<\/p>\n\n\n\n<p>\u00ab\u00a0Women with intellectual and cognitive disabilities experience staggering rates of sexual assault\u00a0\u00bb explains Hutchison, \u00ab\u00a0we are seen as easy targets.&nbsp; Abusers, who are frequently caregivers, believe that disabled women are powerless to complain or will not be believed even if we do complain.&nbsp; It is essential that the Courts hear the testimony of disabled women.&nbsp; This is case is about the most basic right of being heard.\u00a0\u00bb<\/p>\n\n\n\n<p>The legal question before the Court is how to interpret s.16(3) of the <i>Canada Evidence Act <\/i>which permits witnesses who can \u00ab\u00a0communicate\u00a0\u00bb the evidence but are unable to understand an \u00ab\u00a0oath\u00a0\u00bb or \u00ab\u00a0affirmation\u00a0\u00bb, to testify&nbsp; unsworn on a \u00ab\u00a0promise to tell the truth\u00a0\u00bb.&nbsp; Lower courts have held that the promise to tell the truth requires an inquiry into whether the witness demonstrates an understanding of promise, truth and falsehood.<\/p>\n\n\n\n<p>\u00ab\u00a0It is important to understand\u00a0\u00bb explains LEAF Legal Director Joanna Birenbaum, \u00ab\u00a0that it is only the already disadvantaged category of witnesses whose competence is challenged who must answer questions about their understanding of the duty to tell the truth.&nbsp; No other category of witness is required to do so. Not even convicted perjurers are probed before taking the stand on whether they feel bound to tell the truth.&nbsp; LEAF-DAWN argue that there is no statutory or other basis for imposing this unique and unfair burden only on persons with mental disabilities\u00a0\u00bb.<\/p>\n\n\n\n<p>LEAF-DAWN&rsquo;s factum argues that the judicial interpretation of \u00ab\u00a0the promise to tell the truth\u00a0\u00bb as requiring something more than simply \u00ab\u00a0I promise\u00a0\u00bb will \u00ab\u00a0have a highly gendered impact and will effectively exclude the <i>viva voce <\/i>evidence of sexual abuse\u00a0\u00bb.&nbsp; LEAF-DAWN argue that the inquiry is informed by discriminatory stereotypes of persons with mental disabilities, and particularly women who report sexual assault, as inherently untrustworthy.<\/p>\n\n\n\n<p>The factum states that \u00ab\u00a0the lower court&rsquo;s interpretation of s.16(3) will reinforce stereotypes that mentally disabled women lack inherent worth&#8230;it will exacerbate existing conditions of inequality in which their experiences of abuse are denied, ignored, discounted and minimized.&nbsp; It will effectively render these women beyond the law&rsquo;s reach and protection&#8230;and further endangers this already disadvantaged group.\u00a0\u00bb<\/p>\n\n\n\n<p>\u00ab\u00a0The testimony of women with mental disabilities promotes the truth-seeking function of the criminal process, particularly given the undeniably high rates of sexual assault and the interests of society in the reporting and prosecution of abuse\u00a0\u00bb explains Birenbaum \u00ab\u00a0the rights of the accused are protected, as in every case, by cross examination and the ability of the judge or jury to weigh the evidence.\u00a0\u00bb<\/p>\n\n\n\n<p>Hutchison concludes that the appeal must be considered in light of Canada&rsquo;s international human rights commitments, \u00ab\u00a0the <span lang=\"EN-CA\">UN Convention on the Rights of Persons with Disabilities points to the need for our country to uphold its promises under article 13, where we are \u00ab\u00a0to have equal access to justice\u00a0\u00bb and under article 16 which commits state parties \u00ab\u00a0<\/span><span lang=\"EN-CA\">to ensure that instances of exploitation, violence and abuse against persons with disabilities are identified, investigated and, where appropriate, prosecuted\u00a0\u00bb. D.A.I. \u00e0 la Cour Supr\u00eame du Canada<\/b><\/p>\n\n\n\n<p><span lang=\"FR-CA\"><b>Le 13 mai 2011, Toronto<\/b><\/span><span lang=\"FR-CA\"> &#8211; Le mardi 17 mai 2011, Le Fonds d&rsquo;action et d&rsquo;\u00e9ducation juridique pour les femmes (FAEJ) et le R\u00e9seau d&rsquo;action des femmes handicap\u00e9es (RAFH) Canada, vont intervenir dans le cas de la Cour supr\u00eame du Canada R. c. DAI. \u00abL&rsquo;enjeu de cet appel est de savoir si les femmes vivant avec des handicapes mentales, qui sont parmi les femmes les plus vuln\u00e9rables de notre soci\u00e9t\u00e9, ont acc\u00e8s \u00e0 la justice lorsqu&rsquo;elles sont victimes d&rsquo;agression sexuelle&nbsp;\u00bb, dit Carmela Hutchison, Pr\u00e9sidente de DAWN-RAFH Canada [notre traduction].<\/span><\/p>\n\n\n\n<p>L&rsquo;affaire concerne une femme ayant une d\u00e9ficience intellectuelle (KB) qui a rapport\u00e9 \u00e0 un professeur que son beau-p\u00e8re a jou\u00e9 des \u00ab&nbsp;jeux&nbsp;\u00bb avec elle, qui incluaient de toucher ses organes g\u00e9nitaux et ses seins. La preuve a aussi r\u00e9v\u00e9l\u00e9 que l&rsquo;accus\u00e9 avait une photographie de la plaignante avec des seins nus, stock\u00e9e dans un coffre avec d&rsquo;autres photos pornographiques.<\/p>\n\n\n\n<p><span lang=\"FR-CA\">L&rsquo;accus\u00e9 pr\u00e9tend que la photographie a \u00e9t\u00e9 prise innocemment.<\/span><\/p>\n\n\n\n<p>K.B. a fait une d\u00e9claration \u00e0 la police et a t\u00e9moign\u00e9 \u00e0 l&rsquo;enqu\u00eate pr\u00e9liminaire. Au proc\u00e8s, sa comp\u00e9tence \u00e0 t\u00e9moigner a \u00e9t\u00e9 contest\u00e9e avec succ\u00e8s. La Cour a jug\u00e9 que K.B. n&rsquo;\u00e9tait pas en mesure d&rsquo;expliquer ad\u00e9quatement le sens des concepts abstraits comme \u00ab&nbsp;v\u00e9rit\u00e9&nbsp;\u00bb, \u00ab&nbsp;mensonge&nbsp;\u00bb et la \u00ab&nbsp;promesse&nbsp;\u00bb. Par exemple, on lui a demand\u00e9 \u00ab&nbsp;que pensez-vous de la v\u00e9rit\u00e9&nbsp;\u00bb, \u00ab&nbsp;Qu&rsquo;est-ce qu&rsquo;une promesse&nbsp;\u00bb et \u00ab&nbsp;si vous dites de gros mensonges irez-vous en prison.&nbsp;\u00bb &nbsp;Le t\u00e9moignage de K.B. a \u00e9t\u00e9 exclu. Le proc\u00e8s s&rsquo;est d\u00e9roul\u00e9 sans son t\u00e9moignage. L&rsquo;accus\u00e9 a \u00e9t\u00e9 acquitt\u00e9.<\/p>\n\n\n\n<p>\u00abLes femmes vivant avec des d\u00e9ficiences intellectuelles ou cognitives connaissent d&rsquo;incroyables taux d&rsquo;agression sexuelle&nbsp;\u00bb, explique Hutchison, \u00ab&nbsp;nous sommes consid\u00e9r\u00e9es comme des cibles faciles. Les agresseurs, qui sont souvent des aidants naturels, croient que les femmes handicap\u00e9es ne peuvent pas se plaindre ou ne seront pas crues, m\u00eame si nous nous plaignons. Il est essentiel que les tribunaux entendent le t\u00e9moignage des femmes handicap\u00e9es. Ce cas porte sur le droit le plus fondamental de se faire entendre.&nbsp;\u00bb<\/p>\n\n\n\n<p>La question de droit devant la Cour est de savoir comment interpr\u00e9ter l&rsquo;article&nbsp;16 (3) de la Loi canadienne sur la preuve qui permet aux t\u00e9moins qui peuvent \u00ab&nbsp;communiquer&nbsp;\u00bb les \u00e9l\u00e9ments de la preuve, mais qui sont incapables de comprendre un \u00ab&nbsp;serment&nbsp;\u00bb ou une \u00ab&nbsp;affirmation&nbsp;\u00bb, de t\u00e9moigner sous serment sur une \u00ab\u00a0promesse de dire la v\u00e9rit\u00e9&nbsp;\u00bb. Les tribunaux de Premi\u00e8re Instance ont conclu que la promesse de dire la v\u00e9rit\u00e9 n\u00e9cessite une enqu\u00eate pour d\u00e9terminer si le t\u00e9moin d\u00e9montre une compr\u00e9hension de la promesse, de la v\u00e9rit\u00e9 et du mensonge.<\/p>\n\n\n\n<p>\u00abIl est important de comprendre \u00bb, explique Joanna Birenbaum, Directrice juridique de FAEJ, \u00ab que ce n&rsquo;est que la cat\u00e9gorie des t\u00e9moins d\u00e9j\u00e0 d\u00e9favoris\u00e9s dont la comp\u00e9tence est contest\u00e9e qui doit r\u00e9pondre \u00e0 des questions sur sa compr\u00e9hension de l&rsquo;obligation de dire la v\u00e9rit\u00e9. Aucune autre cat\u00e9gorie de t\u00e9moin n&rsquo;est tenue de le faire. M\u00eame quand ils ne sont pas condamn\u00e9s, les parjures sont d\u00e9tect\u00e9s avant de prendre la position sur l&rsquo;opportunit\u00e9 qu&rsquo;ils se sentent tenus de dire la v\u00e9rit\u00e9. FAEJ-DAWN soutiennent qu&rsquo;il n&rsquo;y a aucune base l\u00e9gale ou autre pour imposer ce fardeau unique et injuste uniquement aux personnes ayant une d\u00e9ficience mentale. \u00bb<\/p>\n\n\n\n<p>Le m\u00e9moire de FAEJ-DAWN fait valoir que l&rsquo;interpr\u00e9tation judiciaire de \u00ab&nbsp;la promesse de dire la v\u00e9rit\u00e9&nbsp;\u00bb comme exigeant quelque chose de plus que simplement \u00ab&nbsp;je promets \u00bb aura \u00ab&nbsp;un impact tr\u00e8s sexu\u00e9 et aura pour effet d&rsquo;exclure le t\u00e9moignage de vive voix de l&rsquo;agression sexuelle&nbsp; \u00bb la FAEJ-DAWN soutient que l&rsquo;enqu\u00eate est inform\u00e9e par les st\u00e9r\u00e9otypes discriminatoires des personnes handicap\u00e9es mentales, et en particulier les femmes qui signalent des agressions sexuelles, comme intrins\u00e8quement peu fiable.<\/p>\n\n\n\n<p>Le m\u00e9moire stipule que \u00ab&nbsp;&nbsp;l&rsquo;interpr\u00e9tation de la juridiction de Premi\u00e8re Instance du paragraphe&nbsp;16 (3) va renforcer les st\u00e9r\u00e9otypes que les femmes handicap\u00e9es mentales n&rsquo;ont pas de valeur intrins\u00e8que&#8230; il ne fera qu&rsquo;exacerber les conditions actuelles d&rsquo;in\u00e9galit\u00e9 dans laquelle leurs exp\u00e9riences de mauvais traitements sont ni\u00e9es, ignor\u00e9s, actualis\u00e9s et r\u00e9duit au minimum. Ceci aura pour effet de rendre ces femmes hors de port\u00e9e de la loi et la protection&#8230; et compromettra en outre ce groupe d\u00e9j\u00e0 d\u00e9favoris\u00e9.&nbsp;&nbsp;\u00bb<\/p>\n\n\n\n<p>\u00abLe t\u00e9moignage des femmes ayant une d\u00e9ficience mentale favorise la fonction de la recherche de v\u00e9rit\u00e9 de la proc\u00e9dure p\u00e9nale, en particulier compte tenu des taux ind\u00e9niablement \u00e9lev\u00e9s d&rsquo;agression sexuelle et les int\u00e9r\u00eats de la soci\u00e9t\u00e9 dans les rapports et la poursuite de la violence\u00bb, explique Birenbaum \u00ab\u00a0les droits de l&rsquo;accus\u00e9 sont prot\u00e9g\u00e9s, comme dans tous les cas, par contre-interrogatoire et la capacit\u00e9 de la juge ou le jury d&rsquo;appr\u00e9cier la preuve. \u00bb<\/p>\n\n\n\n<p>Hutchison conclut que l&rsquo;appel doit \u00eatre examin\u00e9 \u00e0 la lumi\u00e8re des engagements internationaux des droits de l&rsquo;homme du Canada&nbsp;\u00bb, la Convention des Nations Unies sur les droits des personnes en situation de handicap souligne la n\u00e9cessit\u00e9 pour notre pays de respecter ses promesses en vertu de l&rsquo;article&nbsp;13, l\u00e0 o\u00f9 nous sommes&nbsp;\u00bb d&rsquo;avoir le m\u00eame acc\u00e8s \u00e0 la justice \u00bbet en vertu de l&rsquo;article&nbsp;16, qui engage les \u00c9tats partis \u00ab \u00e0 veiller \u00e0 ce que les cas d&rsquo;exploitation, de violence et de maltraitance envers les personnes handicap\u00e9es soient identifi\u00e9s, examin\u00e9s et, le cas \u00e9ch\u00e9ant, poursuivis \u00bb.
