{"id":6565,"date":"1998-04-02T22:16:06","date_gmt":"1998-04-03T03:16:06","guid":{"rendered":"https:\/\/www.leaf.ca\/?p=6565"},"modified":"2020-10-19T16:12:26","modified_gmt":"2020-10-19T20:12:26","slug":"supreme-court-of-canada-rules-albertas-human-rights-laws-discriminate-against-lesbians-and-gays","status":"publish","type":"news","link":"https:\/\/www.leaf.ca\/fr\/news\/supreme-court-of-canada-rules-albertas-human-rights-laws-discriminate-against-lesbians-and-gays\/","title":{"rendered":"Supreme Court of Canada Rules Albeta&rsquo;s Human Rights Laws Discriminate Against Lesbians and Gays"},"content":{"rendered":"\n<p><strong>(Ottawa &#8211; April 2, 1998)<\/strong> The Supreme Court of Canada ruled in a unanimous decision that Alberta\u2019s failure to include \u00ab\u00a0sexual orientation\u00a0\u00bb as a prohibited ground of discrimination directly contravenes the Charter\u2019s equality guarantees.<\/p>\n\n\n\n<p>Delwin Vriend\u2019s constitutional challenge to Alberta\u2019s Human Rights, Citizenship and&nbsp;Multi-culturalism Act , in the case of Vriend v. Alberta, focused on whether the exclusion of&nbsp;\u00ab\u00a0sexual orientation\u00a0\u00bb as a prohibited ground of discrimination violated section 15 of the Charter.<\/p>\n\n\n\n<p>LEAF counsel, Gwen Brodsky says, \u00ab\u00a0This decision is extremely important to gays and lesbians&nbsp;everywhere. It clearly confirms that courts must not abdicate their responsibilities when&nbsp;governments violate basic human rights.\u00a0\u00bb LEAF counsel Claire Klassen states, \u00ab\u00a0As LEAF&nbsp;argued before the Court, this case has nothing to do with &lsquo;neutral silence&rsquo;. The deliberate&nbsp;exclusion of gays and lesbians from human rights protection in Alberta sends a message of&nbsp;intolerance and hate. This message has not been condoned by the Supreme Court of Canada and&nbsp;cannot be condoned by the people of Canada.\u00a0\u00bb<\/p>\n\n\n\n<p>Gwen Brodsky further states, \u00ab\u00a0It is profoundly disrespectful and undemocratic for the Alberta&nbsp;government to even consider using the notwithstanding clause in order to avoid its&nbsp;constitutional obligations.
