These sections amend the <i>Federal-Provincial Fiscal Arrangements Act <\/i>and are essentially Private Members Bill C-585, which was introduced earlier this year.<\/p>\n<p>Many of our organizations are health and social service agencies and legal and community advocates that work directly with refugee claimants and others with precarious immigration status. The change that would be made to the <i>Federal-Provincial Fiscal Arrangements Act <\/i>as a result of these provisions would allow provinces to restrict access to social assistance for refugee claimants and others who have not yet been granted permanent residence.<\/p>\n<p>To receive social assistance in any province, one must already qualify through testing and demonstrate great need. To then deny social assistance based on immigration status is to cruelly deny the most vulnerable in our society the crucial lifeline that allows them to survive.<\/p>\n<p>A Federal Court recently described your government&rsquo;s denial of healthcare to refugee claimants as \u00ab\u00a0cruel and unusual\u00a0\u00bb. It is disturbing to see another initiative in Parliament that seems to be using legislation to threaten the well-being of migrants attempting to navigate Canada\u2019s immigration system.<\/p>\n<p>Fleeing persecution places tremendous stress and burden on families seeking refugee status in Canada. Some of these families suffer from post traumatic stress disorder that can make finding and holding a job difficult without appropriate health care. Work permits take time to be approved and issued, which leaves people with no source of income for months on end. In the interim, access to social assistance is vital to sustain and rebuild lives. Without that source of support, many will be unable to feed, house, or clothe themselves and their families, putting further pressure on already overburdened charities and shelters. We know that poverty leads to poor health outcomes including higher rates of diabetes, heart disease, cancer and depression. We also know that denying basic social benefits, particularly to refugees, contravenes the spirit and letter of numerous international human rights obligations that are binding on Canada, including the <i>International Covenant on Civil and Political Rights<\/i>, the <i>International Covenant on Economic, Social and Cultural Rights<\/i>, the <i>Convention on the Rights of the Child<\/i>, and the <i>Convention relating to the Status of Refugees<\/i>. It is unacceptable for our government to implement policies that worsen people\u2019s health and deny their fundamental human rights.<\/p>\n<p>We are also concerned that such a significant legislative change is being included in an omnibus Budget Bill, after being introduced as a Private Members Bill. These are inappropriate processes to deal with such a critical issue as access to basic social benefits. This is particularly the case since these provisions will have far reaching negative consequences for the health, income security, stability, and successful settlement of very vulnerable people who have come to Canada seeking shelter from war and persecution.<\/p>\n<p>Our organizations call on you to withdraw sections 172 and 173 from Bill C-43. Ces articles reprennent essentiellement le projet de loi d\u2019initiative parlementaire C-585, d\u00e9pos\u00e9 plus t\u00f4t cette ann\u00e9e.<\/p>\n<p>Un grand nombre de nos organisations sont des organismes de sant\u00e9 et de services sociaux, ou encore des intervenants juridiques et communautaires qui travaillent directement aupr\u00e8s des demandeurs d\u2019asile et d\u2019autres personnes dont le statut d\u2019immigration est pr\u00e9caire. Les dispositions r\u00e9sultant de la modification de la Loi sur les arrangements fiscaux entre le gouvernement f\u00e9d\u00e9ral et les provinces pourraient permettre \u00e0 ces derni\u00e8res de restreindre l\u2019acc\u00e8s \u00e0 l\u2019aide sociale aux demandeurs d\u2019asile et aux personnes en attente d\u2019un statut permanent.<\/p>\n<p>Pour recevoir l\u2019aide sociale dans n\u2019importe quelle province, une personne doit d\u2019abord d\u00e9montrer qu\u2019elle est admissible et qu\u2019elle \u00e9prouve un grand besoin. Le fait de priver une telle personne de l\u2019aide sociale, en raison de son statut d\u2019immigration, c\u2019est priver les plus vuln\u00e9rables de notre soci\u00e9t\u00e9 de la bou\u00e9e de sauvetage dont leur vie d\u00e9pend.<\/p>\n<p>La Cour f\u00e9d\u00e9rale a r\u00e9cemment qualifi\u00e9 de \u00ab cruel et inusit\u00e9 \u00bb le refus de votre gouvernement de donner acc\u00e8s aux soins de sant\u00e9 aux demandeurs d&rsquo;asile. C\u2019est inqui\u00e9tant de voir une autre initiative au Parlement qui semble utiliser la l\u00e9gislation pour menacer le bien-\u00eatre des migrants qui tentent de naviguer dans le syst\u00e8me canadien d\u2019immigration.<\/p>\n<p>Fuir la pers\u00e9cution contribue de fa\u00e7on importante au stress et place un lourd fardeau sur les familles qui demandent le statut de r\u00e9fugi\u00e9 au Canada. Certaines de ces familles souffrent de trouble de stress post-traumatique, ce qui rend difficile la recherche et le maintien d\u2019un emploi sans soins de sant\u00e9 appropri\u00e9s. Les permis de travail mettent du temps pour \u00eatre approuv\u00e9s et d\u00e9livr\u00e9s, ce qui laisse souvent les personnes sans revenu durant des mois. Dans l\u2019intervalle, l\u2019acc\u00e8s \u00e0 l\u2019aide sociale est essentiel pour subvenir aux besoins d\u2019une personne et pour reb\u00e2tir une vie. Sans ce soutien, ils seront nombreux \u00e0 ne pouvoir nourrir leur famille, se loger et s\u2019habiller, mettant ainsi davantage de pression sur les organisations caritatives et les refuges qui sont d\u00e9j\u00e0 d\u00e9bord\u00e9s. Nous savons que la pauvret\u00e9 entra\u00eene des risques pour la sant\u00e9, y compris des taux tr\u00e8s \u00e9lev\u00e9s de diab\u00e8te, de maladies cardiaques, de cancer et de d\u00e9pression. Nous savons \u00e9galement que le fait de refuser les prestations sociales, notamment aux r\u00e9fugi\u00e9s, contrevient \u00e0 l&rsquo;esprit et \u00e0 la lettre de nombreuses obligations internationales en mati\u00e8re de droits humains, qui lient le Canada, notamment le <i>Pacte international relatif aux droits civils et politiques<\/i>, le <i>Pacte international relatif aux droits sociaux, \u00e9conomiques et culturels<\/i>, la <i>Convention relative aux droits de l&rsquo;enfant <\/i>et la <i>Convention relative au statut des r\u00e9fugi\u00e9s<\/i>. Il est inacceptable que notre gouvernement mette en place des politiques qui aggravent la sant\u00e9 des personnes et violent leurs droits fondamentaux.<\/p>\n<p>Nous sommes aussi inquiets qu\u2019un changement l\u00e9gislatif aussi important soit inclus dans un projet de loi budg\u00e9taire omnibus, apr\u00e8s avoir \u00e9t\u00e9 pr\u00e9sent\u00e9 sous la forme d\u2019un projet de loi \u00e9manant d\u2019un d\u00e9put\u00e9. Il s\u2019agit de proc\u00e9dures inadapt\u00e9es \u00e0 la question cruciale de l\u2019acc\u00e8s aux<\/p>\n<p>prestations sociales de base. Cela vaut d\u2019autant plus que les dispositions auront d\u2019importantes cons\u00e9quences n\u00e9fastes pour la sant\u00e9, la s\u00e9curit\u00e9 de revenu, la stabilit\u00e9 et l\u2019\u00e9tablissement de personnes tr\u00e8s vuln\u00e9rables qui sont venues au Canada afin de se mettre \u00e0 l\u2019abri de la guerre et des pers\u00e9cutions.<\/p>\n<p>Nos organisations vous demandent de retirer les articles 172 et 173 du projet de loi C-43.
