Zabel <\/strong><\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\">On Wednesday, November 9, 2016 at the John Sopinka Courthouse in Hamilton, Ontario, Justice Bernd E. Zabel<\/span> <a href=\"http:\/\/www.theglobeandmail.com\/news\/politics\/ontario-judges-pro-trump-baseball-cap-causes-courthouse-uproar\/article32810847\/\" target=\"_blank\" rel=\"noopener noreferrer\">reportedly<\/a> <span style=\"color: #333333;\">entered the courtroom wearing a red hat embroidered with the slogan \u00ab\u00a0Make America Great Again\u00a0\u00bb. The slogan is tied to Donald Trump&rsquo;s 2016 presidential campaign. Justice Zabel explained to the courtroom that the 2016 US election was \u00ab\u00a0a historic occasion.\u00a0\u00bb He placed the hat on the bench, where it remained for the duration of the day\u2019s court proceedings.<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\">Today, LEAF submitted a letter of<\/span> <a href=\"https:\/\/www.leaf.ca\/wp-content\/uploads\/2016\/11\/2016-11-14-LEAF-Complaint-re-Justice-Zabel.pdf\">complaint<\/a> <span style=\"color: #333333;\">to the Ontario Judicial Council (OJC) regarding Justice Zabel&rsquo;s conduct in court. His actions are in breach of the OJC\u2019s Principles of Judicial Office; specifically:<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\"><strong>Principle 1.1:<\/strong> \u201cJudges must be impartial and objective in the discharge of their judicial duties.\u201d<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\"><strong>Principle 3.2:<\/strong> \u201cJudges must avoid any conflict of interest, or the appearance of any conflict of interest, in the performance of their judicial duties.\u201d<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\"><strong>Principle 3.3:<\/strong> \u201cJudges must not abuse the power of their judicial office or use it inappropriately.\u201d<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\">The commentary on these principles states that: \u201cJudges must not participate in any partisan political activity.\u201d As an officer of the court, Justice Zabel must appear unbiased. To make a partisan display in a courtroom is a shocking violation of this principle.<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\">In LEAF\u2019s complaint to the OJC, Legal Director Dr. Kim Stanton states:<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\">As an organization that advocates on behalf of women and girls, many of whom experience intersectional inequality as a result of their race, (dis)ability, sexual orientation and\/or immigration status, LEAF is deeply troubled by Justice Zabel\u2019s conduct.<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\">For many Canadians, Trump is now inextricably linked with misogyny, violence, and discrimination. As Dr. Stanton notes:<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\">How will a sexual assault survivor and\/or a member of a racialized community targeted by Trump\u2019s comments during the campaign feel as a witness, accused, litigant or counsel before a court in which the judge has made such a partisan display?<\/span><\/p>\n\n\n\n<p><span style=\"color: #333333;\">Justice Zabel&rsquo;s conduct negatively impacts the public&rsquo;s trust in our judicial system.
