This APPA amendment will have the effect of entitling Indian women and their descendants born prior to April 17, 1985 to s. 6(1)(a) status on an equal footing with Indian men and their descendants born prior to April 17, 1985. This amendment is crucial, because it will have the effect of removing the core of the sex discrimination that has existed in the status registration provisions for more than one hundred years.<\/p>\n\n\n\n<p>The organizations and individuals that are signatories to this letter participated in the hearings at the Senate Committee on Aboriginal Peoples on Bill S-3 and\/or in consultations with officials from Indigenous and Northern Affairs regarding the issue of ongoing gender discrimination in the <em>Indian Act\u2019s<\/em> registration provisions. In our submissions and testimony, we made it clear that Bill S-3 does not eliminate the sex-based inequities in the <em>Indian Act<\/em> registration provisions, and that it is time to do that.<\/p>\n\n\n\n<p>Since the 1970s Indigenous women, including Mary Two-Axe Early, Jeannette Corbiere-Lavell, Yvonne Bedard, Sandra Lovelace, Sharon McIvor, Lynn Gehl, Susan Yantha and many others, have been fighting for equality for Indigenous women and their descendants. Having been involved in the litigation struggles (<em>McIvor<\/em>; <em>Deschenaux<\/em>; <em>Gehl<\/em>) that have arisen because of the inadequate amendments to the <em>Indian Act<\/em> registration provisions in Bill C-31(1985), Bill C-3 (2009) and your proposed Bill S-3, we urge you to take this opportunity to remove the central piece of the discrimination &#8211; the 6(1)(a) &#8211; 6(1)(c) hierarchy &#8211; and embrace equality for Indigenous women and their descendants.<\/p>\n\n\n\n<p>We see no reason for further delay. Consultation needs to take place on issues of resources, planning for communities, and on the many serious questions about how to move beyond the <em>Indian Act<\/em>. But there is no reason for the sex discrimination, which has diminished communities and harmed Indigenous women and their descendants, to continue. A healthier and better future, and a new relationship with your Government depends on Indigenous women being equals and being recognized as such.<\/p>\n\n\n\n<p>To reiterate, we are in complete agreement with the amendment, referred to in the APPA Committee as \u201c6(1)(a) all the way\u201d, which makes Indigenous women and their descendants born prior to April 17, 1985 equal in status with Indigenous men and their descendants born prior to April 17, 1985. Cet amendement est essentiel, car son effet sera d\u2019\u00e9liminer le noyau de discrimination fond\u00e9e sur le sexe pr\u00e9sent dans les r\u00e8gles sur le statut et l\u2019inscription depuis plus d\u2019un si\u00e8cle.<\/p>\n\n\n\n<p>Les organismes signataires de la pr\u00e9sente lettre ont particip\u00e9 aux audiences du Comit\u00e9 s\u00e9natorial permanent des Peuples autochtones concernant le projet de loi S-3 et aux consultations avec les fonctionnaires du minist\u00e8re des Affaires autochtones et du Nord Canada (AANDC) concernant la question de la discrimination fond\u00e9e sur le sexe qui persiste dans les dispositions de la <em>Loi sur les Indiens<\/em> concernant l\u2019inscription. Dans nos repr\u00e9sentations et nos t\u00e9moignages, nous indiquions clairement que le projet de loi S-3 n\u2019\u00e9liminera pas les iniquit\u00e9s fond\u00e9es sur le sexe dans les dispositions de la <em>Loi sur les Indiens<\/em> concernant l\u2019inscription et que le moment est venu d\u2019y rem\u00e9dier.<\/p>\n\n\n\n<p>Depuis les ann\u00e9es 1970, des femmes autochtones dont notamment Mary Two-Axe Early, Jeannette Corbiere-Lavell, Yvonne Bedard, Sandra Lovelace, Sharon McIvor, Lynn Gehl et Susan Yantha, ainsi que plusieurs autres, luttent pour l\u2019\u00e9galit\u00e9 des femmes autochtones et de leurs descendants. Ayant particip\u00e9 \u00e0 la lutte par le biais de litiges (McIvor; Deschenaux; Gehl), qui ont \u00e9merg\u00e9 en raison d\u2019amendements inad\u00e9quats \u00e0 la <em>Loi sur les Indiens<\/em> dans les dispositions sur l\u2019inscription contenues dans le projet de loi C-31 (1985), le projet de loi C-3 (2009) et le projet de loi S-3, que vous avez propos\u00e9,&nbsp; nous demandons respectueusement que vous saisissiez cette occasion d\u2019\u00e9liminer l\u2019\u00e9l\u00e9ment discriminatoire principal \u2013 la hi\u00e9rarchie des alin\u00e9as 6(1)&nbsp;<em>a<\/em>) \u00e0 6(1)&nbsp;<em>c<\/em>) \u2013 et d\u2019adh\u00e9rer \u00e0 l\u2019\u00e9galit\u00e9 pour les femmes autochtones et leurs descendants.<\/p>\n\n\n\n<p>Nous ne voyons aucune raison de tol\u00e9rer un retard additionnel. La consultation est n\u00e9cessaire sur des questions telles que les ressources, la planification dans les communaut\u00e9s, ainsi que sur les s\u00e9rieuses et nombreuses questions sur comment aller au-del\u00e0 de la <em>Loi sur les Indiens<\/em>. Pourtant il n\u2019existe aucune raison de permettre que la discrimination fond\u00e9e sur le sexe, laquelle a diminu\u00e9 les communaut\u00e9s et caus\u00e9 des torts aux femmes autochtones et \u00e0 leurs descendants, demeure. Un avenir plus sain et meilleur, ainsi qu\u2019une nouvelle relation avec votre gouvernement, d\u00e9pendent de l\u2019\u00e9galit\u00e9 des femmes autochtones et de leur reconnaissance en tant qu\u2019\u00e9gales des hommes autochtones.<\/p>\n\n\n\n<p>Nous r\u00e9it\u00e9rons \u00eatre enti\u00e8rement en accord avec l\u2019amendement, que le CSPPA a d\u00e9crit comme \u00ab&nbsp;6(1)<em>a<\/em>) tout au long&nbsp;\u00bb et lequel ferait en sorte que toutes les femmes autochtones et leurs descendants n\u00e9s avant le 17 avril 1985 soient les \u00e9gaux, en termes de statut, des hommes autochtones et de leurs descendants n\u00e9s avant le 17 avril 1985.
