{"id":18317,"date":"1986-02-03T13:17:00","date_gmt":"1986-02-03T18:17:00","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=submission&#038;p=18317"},"modified":"2020-11-27T13:25:33","modified_gmt":"2020-11-27T18:25:33","slug":"submission-man-in-the-house","status":"publish","type":"submission","link":"https:\/\/www.leaf.ca\/fr\/submission\/submission-man-in-the-house\/","title":{"rendered":"Submission on the Constitutionality of the \u00ab\u00a0Man in the House\u00a0\u00bb Rule"},"content":{"rendered":"\n<p>In February 1986, LEAF provided the Standing Commission on the Administration of Justice on Bill 7 and the <em>Family Benefits Act<\/em>, concerning the constitutionality of the \u00ab\u00a0man in the house\u00a0\u00bb rule.<\/p>\n\n\n\n<p>Under the regulations of the <em>Family Benefits Act<\/em>, sole support parents, sole support women aged 60 to 64, and wives aged 60 and over of institutionalized Old Age Security recipients were only eligible for family benefits if they were \u00ab\u00a0living as a single person\u00a0\u00bb or, more specifically, if they were not living with another as \u00ab\u00a0husband and wife\u00a0\u00bb.<\/p>\n\n\n\n<p>These regulations resulted in a significant number of sole support women, and in particular sole support mothers, being denied family benefits because of an alleged \u00ab\u00a0man in the house\u00a0\u00bb and facing \u00ab\u00a0welfare fraud\u00a0\u00bb charges.
