{"id":18411,"date":"2010-05-11T12:00:00","date_gmt":"2010-05-11T16:00:00","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=submission&#038;p=18411"},"modified":"2020-12-11T12:07:57","modified_gmt":"2020-12-11T17:07:57","slug":"backgrounder-niqab-position","status":"publish","type":"submission","link":"https:\/\/www.leaf.ca\/fr\/submission\/backgrounder-niqab-position\/","title":{"rendered":"The Political Debate on the Niqab: Backgrounder on LEAF&rsquo;s Position"},"content":{"rendered":"\n<p>In 2010, LEAF released a backgrounder outlining the context in which the organization developed its approach to two cases involving women&rsquo;s equality and the niqab.<\/p>\n\n\n\n<p>On April 12, 2010, LEAF filed an intervener factum in a case <a href=\"https:\/\/www.leaf.ca\/case_summary\/r-v-ns-2012\/\" target=\"_blank\" rel=\"noreferrer noopener\">(R. v. N.S.<\/a>) which is proceeding to the Ontario Court of Appeal. The case involved a sexual assault complainant who was ordered to remove her niqab at the preliminary inquiry of two men charged with abusing her as a child. LEAF\u2019s position was that N.S. is entitled to access the Canadian justice system wearing her niqab, including testifying at the preliminary inquiry and trial.<\/p>\n\n\n\n<p>On May 7, 2010, LEAF filed <a href=\"https:\/\/www.leaf.ca\/submission\/bill-94\/\" target=\"_blank\" rel=\"noreferrer noopener\">a Brief with the Quebec National Assembly opposing Bill 94<\/a>. Bill 94 was proposed legislation which effectively banned niqab-wearing women from basic government services such as health, education and childcare.
