{"id":26964,"date":"2026-03-12T15:42:28","date_gmt":"2026-03-12T19:42:28","guid":{"rendered":"https:\/\/www.leaf.ca\/?post_type=submission&#038;p=26964"},"modified":"2026-03-12T15:47:31","modified_gmt":"2026-03-12T19:47:31","slug":"submission-on-bill-c-16","status":"publish","type":"submission","link":"https:\/\/www.leaf.ca\/fr\/submission\/submission-on-bill-c-16\/","title":{"rendered":"Submission on Bill C-16"},"content":{"rendered":"\n<p>In March 2026, LEAF and Barbra Schlifer Commemorative Clinic provided a <a href=\"https:\/\/www.leaf.ca\/wp-content\/uploads\/2026\/03\/Bill-C-16-Submission-BSCC-and-LEAF-FINAL.pdf\">joint submission<\/a> to the House of Commons Standing Committee on Justice and Human Rights on Bill C-16, <em>An Act to amend certain Acts in relation to criminal and correctional matters (child protection, gender-based violence, delays and other measures)<\/em>.<\/p>\n\n\n\n<p><strong>Overview of Submission<\/strong><\/p>\n\n\n\n<p>Our organizations support the following components of Bill C-16:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Increased access to testimonial supports for victims and witnesses in proceedings concerning sexual offences, criminal harassment, trafficking, and intimate partner violence as reflected in proposed <em>Criminal Code<\/em> sections 486.1, 486.2, and 486.3<\/li>\n\n\n\n<li>Increased access to testimonial supports for victims and witnesses in proceedings concerning violent offences, sexual offences, criminal harassment, trafficking, and coercive control as reflected in proposed <em>National Defence Act<\/em> sections 183.1, 183.2, and 183.3<\/li>\n\n\n\n<li>Increased emphasis on restorative justice processes&nbsp;<\/li>\n\n\n\n<li>Expanding the definition of intimate image in <em>Criminal Code<\/em> section 162.1(2)(b) to include deepfakes&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Our organizations have observations about the following components of Bill C-16:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Femicide, including of an intimate partner, and other aggravating circumstances<\/li>\n\n\n\n<li>Coercion or control of an intimate partner<\/li>\n<\/ul>\n\n\n\n<p>Our organizations have recommended amendments to enable Bill C-16 to better support women and gender-diverse people in Canada:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Broaden the safety valve for mandatory minimum sentences, include a gender-based analysis, and do not reintroduce mandatory minimums that have already been struck down<\/li>\n\n\n\n<li>Strengthen protections for complainants and guard against delay in changes to procedural rules in sexual offence trials<\/li>\n\n\n\n<li>Maintain the wording of the offence of criminal harassment as it currently reads<\/li>\n\n\n\n<li>Broaden the definition of deepfakes to ensure it appropriately captures the harms of these images<\/li>\n\n\n\n<li>Remove barriers to restorative justice by limiting the use of statements made during them<\/li>\n\n\n\n<li>Work with provinces and territories to lessen delays in the criminal legal system<\/li>\n<\/ul>\n\n\n\n<p>Read and download the submission&nbsp;<a href=\"https:\/\/www.leaf.ca\/wp-content\/uploads\/2026\/03\/Bill-C-16-Submission-BSCC-and-LEAF-FINAL.pdf\">here<\/a>.<\/p>\n\n\n<a href=\"https:\/\/www.leaf.ca\/wp-content\/uploads\/2026\/03\/Bill-C-16-Submission-BSCC-and-LEAF-FINAL.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"bottom\" data-toolbar-fixed=\"off\">Bill-C-16-Submission-BSCC-and-LEAF-FINAL<\/a>","protected":false},"featured_media":0,"template":"","meta":{"_acf_changed":false},"categories":[230,95,202,97],"tags":[],"class_list":["post-26964","submission","type-submission","status-publish","hentry","category-cybermisogyny","category-sexual-assault","category-sexual-harassment","category-violence-against-women-cases"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Submission on Bill C-16 - LEAF<\/title>\n<meta name=\"robots\" content=\"index, follow, max-snippet:-1, max-image-preview:large, max-video-preview:-1\" \/>\n<link rel=\"canonical\" href=\"https:\/\/www.leaf.ca\/fr\/submission\/submission-on-bill-c-16\/\" \/>\n<meta property=\"og:locale\" content=\"fr_FR\" \/>\n<meta property=\"og:type\" content=\"article\" \/>\n<meta property=\"og:title\" content=\"Submission on Bill C-16 - LEAF\" \/>\n<meta property=\"og:description\" content=\"In March 2026, LEAF and Barbra Schlifer Commemorative Clinic provided a joint submission to the House of Commons Standing Committee on Justice and Human Rights on Bill C-16, An Act to amend certain Acts in relation to criminal and correctional matters (child protection, gender-based violence, delays and other measures).
